Discharged in 2005 but having credit file problems

Hi All,
I was declared bankrupt in Jan 2004, and automatically discharged in April 2005 with no restrictions.
I have been trying to get my credit file "cleaned" and have followed the sticky with regards to the defaults and 'active' balances, but have a few I'm struggling with.
Before I was declared bankrupt I had 4 CCJs from 2002 with 4 different companies. These were all included in my statement of affairs etc.. but are still showing as active on my credit file. They were all filed with the bulk centre at Northampton but when I spoke to the court they told me that they would not be marked as satisfied until I paid them in full despite the bankcruptcy.
Please can anyone advise what I should do?
Thanks in advance

Hi Moussey,
That is incorrect, and I have the feeling that fermi will give you enough bed time reading to make you sleep through the worst possible storm.

I've not really checked to see exactly how records of the CCJ should be updated.
That's because the CCJ for a debt that was included in your bankruptcy will be recorded on your CRF's with a date that is before your bankruptcy. Like the bankruptcy order itself the CCJ will fall off your CRF 6 years after it was registered, satisfied or not. Before the bankruptcy itself drops off.
In other words the worst record on the CRF (the BR) will be on there for longer than the CCJ's are. While the BR order is on the CRF the effect of the CCJ's being there as well is tiny.
With your CCJ's being in 2002 they will be due to drop off some time this year anyway, long before the bankruptcy does. So it's a bit academic really.
You could contact the Registry Trust to find out if they should be marked as satisfied:

But it's only the court who has the authority to update the records.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Thanks fermi, when I spoke to the court they told me that the CCJ will stay on for 6 years from satisfaction (not default) and so I thought it more of an issue.
Will investigate with the registry trust though as would like to see them satisfied, or at least marked as partially satisfied!0 -
Hi fermi,
I was hoping and praying you weren't on your way out; my mind has shut down for the weekend.:A :A
For future reference, those CCJ's should be marked as satisfied at the date of the B.O shouldn't they??
EDIT: They are marked as satisfied, or aren't they???0 -

As far as I know (and have always been told) it's six years from the judgement date, then removed. Will investigate with the registry trust though as would like to see them satisfied, or at least marked as partially satisfied!
Will be interesting to hear.
The RT website only says:Q. If I have been discharged from bankruptcy or sequestrations, will my judgments be removed from the register?
A. No. It is a different process. Each judgment or decree must be dealt with separately and then marked as satisfied.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Reading the Registry Trust site "From 6th April 2006 when the court are provided with evidence that a judgment debt has been paid in full, that court should notify us to amend the register. When the debt has been repaid outside one calendar month of the judgment date the register will show the entry as "satisfied".
Question - Does a discharged debt from bankruptcy count as payment in full?
The FAQ on their website also says....
39. If I have been discharged from bankruptcy or sequestrations, will my judgments be removed from the register?
No. It is a different process. Each judgment or decree must be dealt with separately and then marked as satisfied.
Question - Does this mean that they should be satisfied or not?

I noticed some else asking much the same questions last weekend on another forum.
They didn't get a definitive answer either.

Ok. Someone who really knows what they are talking about has replied to the thread I linked to in my last post.
I think that clears it up.
Also confirms that the CCJ will disappear from the CRF's before the BR, making it a slightly academic exercise anyway.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB
