Debt Collection Agency for a debt from over 10yrs ago

Hi,

Today a letter came through my door from a collection agency in reference to a debt I had from an Argos store card over 10 years ago! (I recently went onto the private electoral role, I thought going private would of prevented this).

Anyhow, they are requesting over £600 which I don't have being a full time student, and it was over 10 years ago in fact when they put a default on my credit history.

Can they still demand this money from me? Will I be CCJ'd again because of it.

Kinda worried, I only went on the electoral role for the chance to build my now clean history, not for skeletons to ruin it all again.

Many thanks.

Not Mackenzie Hall is it?? Chancers. Write back saying that the debt is now statute barred (more than six years old) and as such you don't acknowledge it.
You still owe the money, but they can't make you pay it at all.
  • Hi,

The company is Debt Managers Ltd in Edinburgh, I think i will do that, was going to ring but I guess writing will be more formal.

I'm dreading getting another thing like this on my Credit History, can they put anything on it a second time do you know?

Don't think they can, but I'm sure someone more knowledgeable than me will be along soon to advise you.
There are template letters on the forum somewhere that you can use to write to them, use these as it's important you don't acknowledge that you owe any debt to them.
And don't sign anything, print your name at the bottom of the letter, these scum have been known to use your signature against you, I beleive.
Good luck in getting it sorted!

  • Thanks Sagaris,

Going to check these templates out now.

    EDIT:-

I'm going to send them this letter from here:-

Hi Tech Guy, do you already have a CCJ for this debt? Or was that others you were referring to?

Like sally said its statute barred and they cant enforce it unless you admit to it! Never admit lmao! If you call them thats what they will try to get you to do (recorded phone line)...........

Like everyone else said just send a letter saying you never owed the money and that its statute barred anyway. Simple!
  • Thanks all :)

Yeah the CCJ (Default actually) was for this debt, the original debt was for around £1100 at the time, and if I remember correctly, after letters and such at the time, I then sent them £500 towards it. Seriously, must be 11 or 12 years ago now.

Not sure it is time barred if you have a CCJ for it, try posting on the DFW board asking that question specifically. (I could well be wrong of course..)

hang on a sec, you say 'default actually' do you mean you defaulted and then they got a CCJ (county court judgement) against you. Or are you just using the acronym CCJ as a substitute for 'default', and they never actually got a CCJ? Or do you mean a CCJ by default because you didn't go to court? (Sorry getting confused)

Anyway, if you do have a CCJ would check out on the DFW board as above.

A debt recorded with a County Court that results in a CCJ is always enforcable, and the Limitations Act does not apply, unfortunately. There isn't much you can do, apart from maybe offering a full and final settlement???
