Refusing to pay Ground Rent

I live on a new development of 26 houses and have been here 2 years now. However the developer has not finished the road /curbs etc and they are still in a mess.
Most residents (including myself) are refusing to pay ground rent to the developer as a protest to the lack of progress in getting the road adopted.
They are now threatening legal action/ debt collection agencies etc if the ground rent is not paid within 7 days. Someone told me they cannot do anything for 3 years, is this true? This relates to the ground rent for 2007, I paid the years before because I thought it would have been sorted .
All the developer say is that they are in discussion with the council regarding road adoption and when I speak to the council they say I need to speak to the developer!
Any help would be appreciated, especially relevant sections of acts/regulations I can quote to them.
