Car insurance, cancellation fee within first 7 days!!

HiI called my car insurer to cancel a policy I have bought 7 days ago and they want to charge me £35 cancellation fee which has never been mentioned to me at the time on the phone when I was unsure to buy or not to buy. The man said ''buy it now and if you change your mind you can cancel during your cooling off period'' I thought ok. Now, they said they will go through the call recording to see what excactly has been said. What are my options? Can I take them to court for trying to charge a fee that their salesman made feel it doesn't exisit, the cancellation fee that is? Or pay up and move on? It seems I have learnt my lesson the hard way!!!
Any advice will be gratefully received!

Well if they are willling to go through the recording then that would seem a sensible option to take. Can I take them to court for trying to charge a fee that their salesman made feel it doesn't exisit, the cancellation fee that is?
Yes you can but it might be cheaper to make a formal complaint first.
It also might be better to get the transcript of the call to see whether you have a good case. When you hear it in the cold light of day, it could be better or worse than you remember.
I would do both of these before going to court.0 -
Hi Lisyloo
Thank you for the fast reply..
I told the lady the exact day, date and the time the call was ended in addittion to the name of the person who sold me the policy. She said they will get back to me today or tomorrow the latest to let me know what the head office think of the recording.
When I took the policy out, there was something towards the end that I wasn't sure of and when I expressed my concerns, the salesperson said something along buy it now and cancel later as you have 7 days cooling off period if decided not to carry on.
Many thanksBe nice, life is too short to be anything else.0 -
Hi
They called today to say the tape has been listened to and there was a mention of £35 cancellation fee which I can't remember! I asked if I can listen to the call again, they said I would need to contact the head office.
I decided to pay the fee for a quieter life!

Are you sure the charge isnt just for the time that you have been on cover? even though there is a 14 day cooling off period, you will be charged for the time that you have been on cover as even though you want to cancel you have been insured for 7 days and will need to pay the appropriate amount to cover that.
Read through your documentation which you will have received along with your cover note or certificate - it will be on some piece of paper about the cooling off period, i think possibly the demands and needs section - correct me if im wrong, sorry im very tired lol!0 -

You are entitled to a copy of the call recording but again you have to pay for that!
