help req on holiday cancelation

Hi I don't know if any one can help me but i had booked a holiday with lunn polly and for one reason or another i can no longer go on the holiday, so i have asked them if i could change the booking and they want £180 admin charge wich i have told them i am not willing to pay , but i have noticed the original contract that they gave me i did not sign,and i am not due to pay the deposit till sept, am i still liable to pay the deposit if i did not sign this agreement and can they take the money off my credit card

    My understanding is that even if you cancel a card and leave the card issuer completely, let alone ask them to issue a new card, if someone then makes a lawful claim against that “redundant” card the issuer will still honour it and come after the card holder to pay.

    On the matter of the contract this is a grey area. Whether you have signed it is irrelevant. A contract may still exist and you must have done soimething to get yourself in the situation where you booked the holiday and then tried to alter the booking. It is therefore very likely that by some performance on your part a contract will exist andLunn Poly will have the right to pursue you for any monies they consider you owe them.

    If I were you I would not just ignore Lunn Poly but speak to them again and ask why they think you have a booking as you never signed the booking form and returned it as you had changed your mind before they issued it. See what their reaction is and then decide what you feel comfortable doing. Also chalange the Admin fee they are cliaming if you want to try and alter your booking. Say you see it as a penalty that is not enforceable in English Law. Say you are prepared to pay something that is fair and reasonable and can be justified. Speak to a Manager or Supervisor, as they normally have more discretion about what can be done.
