WARNING! DLC AKA Hillesden Securties

    Hi,

    I have been struggling to obtain credit recently and i couldn't understand why - so i checked my credit report and their is a 'default payment ' listed by Hillesden securities. Previously i had an account with a bank but i settled my account with them and paid off all monies owed.
    Hillesden Securities contacted me 6 months later and said I owed money... apparently from my account with the bank... Which i knew wasn't true as i had paid it off...They were adamant i owed this money but i disagreed and aked for an investigation , which after checking they confirmed no money was owing and the 'debt' had been sold on in error from my previous bank and no further action would be taken.

    So now i'm wondering, why have they put a current default payment on my credit report? when they investigated and it was proved i owed no money. I want this removed from my credit report as its untrue, Is this possible & can you advise whats the best way to deal with this please?

    If they have placed a false default on your report, then they are breaking the Data Protection Act by doing so.

    Just received the above email addressed to my wife but sent to my email.
    As far as I'm aware my wife has no debts. I foolishly replied asking them to send details by post, should have read the forum first.
    Should I ignore all other letters/emails?

    Wait to see what they send.

    Presuming that it is not her debt then she can tell them to bog off or ignore, whichever seems appropriate.

    Treat it the same way as you would any other spam to your inbox. Which is just what it is.

    Delete it and block the sender.

    Unless you receive a letter stating your correct details and you owe £XX.XX on an account that you recognise, they have the wrong person.

    Hi,

    I'm hoping someone can offer me some advise?

    I purchased a car on PCP in 2005 which was over 3 years with a balloon payment at the end. After the 3 years were up I decided to return the car to Bank of Scotland and the account was settled.

    In 2010 I was in the process of buying a house when to my horror I was told I could not get the mortgage I wanted due to a default on registered on call credit for £3298.80. It was registered by Hilsden Securities Ltd, a company I had never heard of or had any sort of credit agreement with???

    After further investigation it seems they were sold a non existent debt by Capitol bank (formally Bank of Scotland) for my car. I have explained this mistake over and over to Hilsden, DLC and all of the other company names they use but I have gotten nowhere and over 2 years later the default still remains and has now spread to Experian etc as well.

    I do not owe this money and I dont see how a company who has no credit agreement with me can register a default against me? Bank of Scotland or Capitol Bank never registered one and the account was shown as settled.

    Can anyone help me please? My credit history is in tatters through no fault of my own and I cannot obtain credit because of this outstanding default. The default was registered in November 2009 so will not be removed from my file until November 2015!!!!

    If you want this default sorted then you have some work to do. All of it in writing. The noise from Hillseden might increase for a while as you will have become a "live" account (if not already).

    1. I would write to Hillseden telling them they are collecting and reporting on a settled account and that you do not owe them anything. Head the letter Account In Dispute and request a full statement of account from them, including all debits, payments and charges. Tell them that they should stop collection activity they investigate. Also add (clearly) them that you will communicate with them strictly in writing.

    2. Submit a SAR to the original creditor (HBOS now?). It will cost you £10 but money well spent in this case I think. There are template letters around for this (use Google). (A SAR is a Subject Access Request made under the Data Protection Act 1998 and should get all the proof you need that the account was settled. They have 40 days to comply).

    Collect your evidence and then you can take the next steps to getting the erroneous default removed.

    I had a letter from DLC which listed their "client" as "Hillseden Securities, formerly MBNA". As they are not formerly MBNA but merely a purchaser of their outstanding accounts, could this claim be a deception on their part?

    No, they're saying that the account was formerly an MBNA account. It was bought by Hillesden - DLC (they're one and the same).

    Do you recognise the account? When did you last make a payment to it?
