To get back to the original post, I don't see how they can refuse you compensation. You have a contract with them. They can say that insurance only covers you if you had a valid postcode, but that only counts if they told you that AT THE TIME you gave them the parcel.
There is a very famous law case that comes to mind. Woman checked in to a hotel and left her fur coat in the room. It got stolen. Hotel denied liability because it said that there is a notice in every room that says the hotel is only liable for stolen items if they were left in the safe at reception. She sued them and won. Reason: the contract was made when she checked in. The hotel can't rely on a disclaimer of liability that it didn't tell her about until later.
Obviously I am not saying it's worth suing them for this. As I recall, the compensation is quite limited anyway for recorded delivery. Maybe that's what they're counting on.Eh?? I give up!! Towel is getting thrown in here!0 -
i think RM do everything they can to get out of paying compensation. i too tried to claim when a ticket i sent got lost. this was their reply.
"unfortunately, i cannot pay your claim as items of a negotiable value like money tickets & vouchers sent by the service you used are not covered by compensation. i enclose information on our special delivery service, which we recommend you use when sending valuable or urgent items in the future.
i will be replying to them as when i sent the item, i said it was a ticket they asked the value as it was only coverd up to £30. & they never told me that it wasnt covered.0 -
My girlfreind works in post office and since May all offices should check the postcode is on the R Mail system before they accept any Recorded/Special item.
It might be worth apporaching the office who accepted the item as they obviously were not fllowing procedures correctly.
