Deposit Protection Scheme

Hi,
Moved into a property with my brother in October and paid 600 pounds deposit and 525 rent. This was paid directly over the counter into the landlady's bank account. I have just read some information about Deposit Protection Scheme, which says that the landlady has to put our 600 pound deposit in some scheme. However she has not done this. Our tenancy agreement ends in april, and we wish to stay here still. However according to this website (link at bottom) it says that I should go to the county court and the judge will order the landlady to put the deposit in a sheme AND order that she pay us THREE times the amount?!?! Is this true?? Should we do this?!?! All seems very confusing to me. Any advice would be helpful.

Hi Mogimorgan, I am a landlord and the rules state that I have to place the deposit into a scheme within 14 days - and if I dont do it you can claim 3 times the rent!! Also, unless the deposit is protected, I cannot issue you a section 21 notice to quit the property- any landlord who does not do this, must be simple. However, on talking to a solicitor recently about one of my tenants, he pointed out that I was the first person he knew who had protected the deposit!

I was wondering about this too. Have been in my flat for 3.5 years - last renewed in June 07.
2 weeks ago i realised i hadn't seen anything about the protection and asked the landlady. She put the deposit in then (so a long time after she was meant to) and sent me details.
Should I be going after her for 3 times the amount? I don't want there to be bad feeling, but my deposit is 1800 and 3 times that is a lot of money!

Well the landlady has defo not put the deposit in any scheme, and if I can claim THREE times the amount, so 1800?! that would be amazing. However I presume if we did that she could just not renew our tenancy in April and we would have to find somewere else to live! lol Which I really don't want.
Sorry whats a section 21 notice? Sorry this is the first property I have rented and its very confusing. I think I may pop round to the CAB sometime and get some more info!
