Nintendo charges fo faulty item

Hi, like many people I had trouble sourcing a Nintendo Ds over the Christmas period so I ended up getting a Gold one from Play-Asia.com. I paid around about what it costs over here and I paid tax duty on it too.
However, the catch broke and I sent it to Nintendo to be fixed. They wouldn't return it to me unless I paid them £30.50. I pointed out that surely it should be fixed under warrenty as it was faulty but I was told that I didn't have a warrenty because I bought it outside europe?
I am a bit annoyed about this as I didn't get it any cheaper, I paid tax on it and it was brand new and they admitted it was faulty but said it had no warrenty with them.
Is this correct and should I pursue it?
Thanks.x

I'm sorry, but when you buy from overseas you need to check that the manufacturer's warranty is worldwide (or at least covers where you are). Nintendo obviously do not offer a worldwide warranty. So you have to pay.
Of course, you may have recourse to the retailer in whatever jurisdiction applied to the transaction.

yup you chose to buy outside the EU so took the risk without a global warrenty0
