Received fake DVD: ask for refund or 'chargeback'?

I've just received a DVD that I thought was new, from a seller who appeared genuine & to my annoyance it is obviously a copy.
I suppose I should know better by now, but the seller had 100% feedback, said he was selling off surplus stock due to moving and stated that all DVDs are 'brand new'.
He also states 'full refund if not satisfied'...well, obviously I am not satisfied & I want my money back...not because it cost a lot (£5) but it's the principle. I can't stand these sellers who genuinely mislead people over what they are buying.
I thought things were looking a bit suspect yesterday when I looked at the auction again & noticed he's received a neg for selling a copied DVD..now today he's got another 4 negs and he's made the comments private so people can't see what the negs are for.
So, should I do him the courtesy of asking for a refund...I'm not entirely convinced I'll get it, since the guy is obviously a liar..or can I just go straight through paypal and do some sort of chargeback? (I don't know how chargebacks work, I've just vaguely heard of them.)
He's not currently selling any more items, so I'm not sure if I can also report him to ebay for this.

yup let him know that your not happy with the condition and that u may think its fake and that u want a refund, if he said that he'd give 'full refund if not satisfied' that im sure thats what he'll do.0

I had a situation where I was sent a copy DVD last year. The seller had a very high 100% feedback rating. I emailed him and told him that unless he refunded me the I would report him to ebay. He refunded me and didnt even ask me to send the DVD back. After that, I tried the DVD .... It didnt even work.If you found my comment helpful, please click the 'Thanks' button below :T0 -
I find this immensely annoying as well - and for this reason I stay clear of any DVDs announced as multiregion, region 3 or even region 1 as these are often in my experience pirates. I rarely pay more than a 2 or 3 quid for a DVD on ebay because of this risk so I don't really lose much. And if it is a pirate - I leave positive feedback (at least it was delivered) but make it clear that it was a copy being advertised as genuine so others can avoid or not in the future.0

Just to update, I emailed the seller re: a refund, but suprise suprise got no response as yet. At least the DVD actually played fine ..it was the latest Harry Potter & I watched it last night, but still...not the issue.
I wasn't going to leave a comment on his feedback as there would be no point...he made the comments private since receiving some negs, so no-one would see the comment anyway. And this morning he has been NARU'd..whether by Ebay, or if he has de-registered himself, I don't know.0 -
I've had a couple of fake ones in the past and I've learnt my lesson. I only bid on used region 2 films that have an actual photo of the DVD showing the holograms/logo's, and then only after I've asked the seller where they purchased it from (with a comment that if a fake DVD is sent they will be reported to eBay and FACT).
In addition I make sure all films are on release - I noticed loads of Region 1 Million Dollar Baby's for sale, even though it's not out in the USA yet.
Since I've employed this policy I've not had a fake one come through. I now also go to reputable R1 retailers such as DVDSoon, CDWOW, PlayUSA for R1 discs.Never argue with an idiot. He will bring you down to his level and beat you with experience.

To be fair, copied DVDs could still be "brand new" LOL!
I would only purchase if the ad expressly stated that they are "original".The reason people don't move right down inside the carriage is that there's nothing to hold onto when you're in the middle.0 -
The DVD, as you said, works and you have watched it. Therefore you have got the latest Harry Potter DVD for considerably less than you would have expected and it served its purpose. I would just do a chargeback if you are really that angry but the majority of DVDs on Ebay are copies or pirates at the moment.0

Me too and from all these deatils got to be the same person. He emailed me and told me if I return the dvds he will give full refund including postage. I have told him he to send me cheque and then he can have his dvds. He lied about them in the first place how can I trust him to refund me. Also without any evidence I can't do him any harm can I? he hasn't answered yet. You'd be amazed at the amount of pirate DVDs out there. Saying that, many region 3 dvds are not pirates. I buy loads of region 3 dvds online (from proper sites, as opposed to Ebay). They certainly aren't fakes, and are sometimes better than their regions 1 and 2 counterparts. Incidentally, I bought a fake dvd on ebay four years back. I ended up threatening to report the seller to FACT. I also refused to return the dvd, as I wanted to destroy it to stop him selling it again (I wouldn't have done this had he not got stroppy with me when I first asked for a refund). Anyway, here's the feedback he left me:After I sent her cheque back she refused to send me my bootleg dvd. Watch HER !!
Suffice to say, he was banned from Ebay soon after.
