Since you are on first name terms with F.A.C.T could you ask them where there is any reference to The Copyright and Related Rights Regulations 2003.
They seem to have references to a lot of other, older laws that have severe penalties but nothing contemporary. This may be creating a false impression of the law as it stands.

I am not here to police how a regulatory agency applies legislation within the UK. I asked a question as a consumer, got an answer as a consumer, and will apply that information as a consumer.
If you feel that you would like a more definitive answer as to why they seem to be ignoring certain parts of the legislation, then you can contact them the same way I did, by emailing them at [email="contact@fact-uk.org.uk"]contact@fact-uk.org.uk[/email] . This way you, too, can be on first name terms.

@criminal_smile Thankyou for your enlightening forum members with your communications with the F.A.C.T organisation. I am sorry that you feel you cannot proceed with my request. I probably asked too much of anyone. If it takes 8 weeks to get through I thought you had a good chance of fast tracking my uncertainties and their lack of up to date legal quotations.

The F.A.C.T organisation is not a regulatory body but a well funded pressure group that is prepared to fund private prosecutions, lobby for adequate enforcement of copyright protection and assist with forensic advice and assistance to the victims of copyright theft. I support their aims as so many existing laws are passed and ignored by the enforcing authorities.
If their website is misleading/out of date then I cannot complain to a regulatory body. I was for fair use legislation but I advocate fair exchange of duff media legislation.

Np Joe. I think the only reason I got a reply this time was because I complained that no-one had answered a previous email (perhaps I should try this with everyone I want to respond quickly?). To be honest, as I don't generally have much to do with copying cd's, copyright protection etc isn't an issue for me, and as such, I really don't have much interest in which pieces of legislation are applied or not.
Considering the response from FACT, and your info that there is updated legislation available, it does tend to perhaps show a certain amount of apathy from the enforcement bodies, or perhaps a realisation that policing the law may be financially inappropriate, except in the case of the organised crime rings copying for huge profits.
There is a section on the FACT website showing which legislation is used, and who has responsibility for it, but there are no mention of CARRR 2003, or DMCA 2000 on there. Seems to pertain mostly to The Fraud Act, and explaining the police powers of arrest under it.
