Back dated sick pay

My OH hasn't been well enough to work for quite a while now but hasn't claimed anything. He can no longer afford to go on like this but still isn't up to working.
He has seen his GP, ooh maybe once every month since September so the GP will be aware of his "under-the-weatherness".
Anyway he's got another appt to see his Doctor and I was wondering what the likelihood is of OH being able to get back-dated sickness benefit or whether he would only be able to claim from when his GP signs him off.

    Assuming your husband does not have an employer, the time limit for claiming Incapacity Benefit (IB) is 3 months. If he had an employer, they should have considered SSP.

    I suggest he claims IB from the earliest date (Sept 07?), and his GP should be able to issue a pink sick note Med5, from when he first saw your husband.

    Claim IB today by ringing JCP on 0800 055 6688.

    Assuming your husband qualifies for IB, he will have lost any money more than 3 months back before today- but should still claim from Sept 07.

    When he calls JCP, he should also apply for Income Support, unless you work.

    I will suggest he asks doctor about pink sick not med5 form.

    I was not able to get a sick note from my doctor to cover certain dates previous.

    I was asked in a letter from the benefits office to get sick notes to cover me from 3 months previous between certain dates but he said that its illegal to do so.

    So Ive lost out of around £500 pounds I could have claimed.

    I didnt get SSP as I was Self-Employed.

    Can you still ask for the Sick note even if you didnt ask for it at a the time of consultation?

    A GP rightly cannot issue a sick note for a period he has not seen you.

    However, if he did see you on xxx date, your GP should know the rules about issung certifcates which are here-

    It is his decision about if he thought you 'should refrain from work' at that time, and should have considered the issue of a sick note- but only if s/he examinated you at the time.

    You may wish to read/print the relevant pages from section 2 of the DWP guide IB204 for your GP.
