  • DOes the bank make a difference? - I'm only curious as I'm a bit wary of posting too many details on the interent
  • will they reduce the final amount? robinson way took 20% of my ohs debt as hes paying it in one big chunk.

    Above that it says User CP, then Private messages?

    Click and send a private message. Make sure it is to RAS not ras.

    If is is MBNA by the way, there is a good chance the documentation is not leggaly binding.

  • If you speak to them on the phone and you ask for a letter of confirmation from them then its highly unlikely you will get one from them. It would be much better for you not to pay anything today. Once they have your money before you have anything in writing from them to say it is now settled in full, they can come a chasing again and it could easily be picked up by another DCA. You really need a full breakdown of the debt, make sure you are actually paying the right amount. Honestly please do not have any contact by phone. Everything has to be in writing only. Keep copies. If you speak to them it is your word against theirs.

    It appears that he started re-paying just inside the 6 year limit, so he has to pay the debt.

    Your partner must not make any payment until he has received a letter confiming that the payment is full and final settlement and that this will go on his default.

    Otherwise it will go down as partial payment, they will sell the debt on and he will get chased by another DCA for the rest. And on and on until the whole debt is recovered, plus fees.

    Just tell tehm that you have taken legal advice because someone warned you about the potential problem.

    And do not pay be credit or debit card as they could just take the extra.

To date I have not received any confirmation that this amount, if paid, will be in full and final settlement of the account.Please confirm in writing that the amount of £950.00 will be in full and final settlement of the account and that once the full and final settlement of £950.00 is paid then neither you nor any associate company will take any other action to enforce or pursue this debt in any way whatsoever and that I will be released for any liability. I further request that within one month of payment, you will make an entry on a credit reference agency file relating to the above account as “satisfied” in full.Payment can be made within 1 week of receiving your written agreement to the above."Do you think this will be enough?

  • Is this the amount the bank say you owed them or has RW given you the amount. Have you thought about disputing the amount re charges on account etc. I know the bank charges reclaim are on hold but it maybe worth getting your claim in the pipeline. Ras is there anything you can add to what i am trying to say here. Stassy do you have the bank statements fot this account. Can you look back to see what charges if any are on there. Also as one poster has said you maybe able to get a reduced amount to pay. As long as you have it in writing they will settle the debt at that amount. Oh i know what i am trying to say but its coming out all wrong. Sorry guys. Will leave this to the folk who know more about it.
