Robinson way - final payment due today

Hi all (very first thread so apologies if I do this wrong),My partner had a loan debt transferred from a bank to Robinson Way. He was contaced by RW and agreed by telephone to re-pay the debt over 5 months with low payments and one large final payment. After reading a number of posts on this site I am rather concerned that he has not had any of this in writing. He has however received monthly reminder letters with paid amounts having been deducted from the 'Amount due' stated on the letter. He is due to pay the outstanding amount today by telephone and from what I have gathered from posts I have advised him to confirm the following when he phones them: 1) That the amount of £950 is payment in full & final settlement of the account and 2) once this full & final settlement of £950 is paid they will make an entry on a credit reference agency file relating to this account as 'satisfied' in full. Will this be enough to cover himself?

How much does he owe? Will the final payment cover the whole debt or just part of it?
If it is only part, he should not pay until he has confirmation in writing. If you've have not made a mistake, you've made nothing0 -
Dear RAS, The final payment is for an agreed by telephone total amount of £1520.00 (which is now £950.00 due to payments made over the last few months). The original debt from the bank was £2227.57So therefore it is not the whole of the original debt but a reduced amount.0

You need written confirmation that it is indeed full and final settlement.Total 'Failed Business' Debt £29,043

Absolutely
Have a look at the mess jaggedpixel is sorting at the moment if you want to see what we mean.
How old is this debt and have you done a CCA on it?If you've have not made a mistake, you've made nothing0 -
It will most likely be marked as part settled on his file and it will remain on his file for the next six years - what you need in confirmation is that they will not be chasing for any further payment towards the debt and that they will not "sell" the outstanding balance to any other debt collecting agency.I am a debt counsellor working in the voluntary sector - we don't charge our clients for the work we do!0

Thanks immoral_angeluk. I'll make sure he gets written confirmation. I'm just so glad this is finally coming to an end. It has been very hard to motivate him to face this debt (the original bank loan debt was about 3 years old, before I met him). For someone who has never been in debt I couldn't really understand how easy it is to for someone to get into debt and bury their head in the sand over it and not deal with it. I realise now how hard it can be. This site has also helped me to understand and its really nice to see how many people there are out there in this otherwise crazy world that are willing to offer their unconditional support and advice to people0

How old is this debt - when did you meet him?
PLEASE answer.If you've have not made a mistake, you've made nothing0 -
ok...so I've just tried to explain everything that you all have written here to my partner and his response is: what if they don't agree to write confirmation that this is his full and final payment?0

RAS, The debt was created with the bank in 2002. We have only been together a year or so.0

Debts are statute barred after 6 years. If you partner had not started paying again recently, he would not have had to repay any of this debt. if there was a 6 year gap between his last payment and when he restarted payment, it may still be statute barred.
Have you DONE a CCA to confirm that the required documentation is in place for this debt?If you've have not made a mistake, you've made nothing0
