Incapacity Benefit is not means tested, so he won't lose that. Is he definitely claiming IB, and not IS?

Unless your partner is protected under the transition arrangements (his claim would have started before 1995), if he has been claiming IB for more than six months his income will be counted. IB at the short term rate is not counted.

  • thanks for replying. my partner has been claiming IB and IS since 1997. The majority amount of his benefit is thru IB. im fairly certain he would lose his IS but not sure about his IB entitlement.

IB will count towards your tax credits calculation, but he will not lose it. IS will take into account your income, so yes, he probably will lose it.
