Debters Petition - Spoke to court - Urgh!!!

So I rang the court today to find out what the cone thing is. Had a battleaxe on the phone (baby was moaning with earache all day). I told her I had filled in my Statement of Affairs and wanted to know where to go next. Nowhere she replied because I have not filled in a debters petition form. Whats that?!

She said I need 2 copies of both and the fee. I turn up before 10am and swear an affidavit and then wait to be seen by the judge if he has time .

So now need to fill in this debters petition. Can someone tell me where I get that from and seeing as I have done my SOA online, do i still have to print off 2 copies?

I keep thinking I am going to be sent to prison or something - my debts are huge in comparison to everyones on here.

The debtors petition should be printed/created with the rest of the SOA online. At least that's what others who used the online forms have said.

If you want to download and print out a blank copy, it is here:

    Hi NME,

I've an idea fermi is going to post the links to the Debtors Petition; he's younger than me and always "beats me to the draw".:D :D

Some of those Court secretaries are like doctor's receptionists; better off treated with the contempt they deserve.:D

Er, not much point a father of four suggesting calpol to a mother of three.;)

Your debts are probably in the top 20 on here NME, but not the top 5.:T :T

If fermi doesn't post soon I'll look for the links for you.

    Hi NME

The statement of affairs form 6.28 and the Debtors Bankruptcy petition 6.27 need to be printed out and filled in. You will need to provide 3 copies of these and then you can call the court again to ask for dates and times of bankruptcy hearings.

Well one of them's here, and I do believe in the top 3; c'est moi. :D No prison sentence; no BRU/O; no IPA; just a love of life and faith in the future.

I think the Debtor's Petition is reasonably straightforward; famous last words.

Do you mean going to Court? It's more fun than a day out with young children; especially if they've got their badly behaved friends with them.

Have you got somebody who'd go with you for moral support?

  • NME, I found that form more taxing that the Statement of Affairs :o , so just in case you struggle with it too, have a look at my thread from yesterday, some great advice from Fermi and Richard on it :D

    Thanks for that Scarlett,

I knew I'd been through one of those recently, but couldn't remember where.:D :D

And if femi was there too, then it'll be 110% correct; all perfectly referenced and usually with examples and a bibliography; anybody would think that guy is a scientist.

Good luck with it NME :)

Oh, and if we're doing "top 20 amounts of debt" I reckon me and himself might be quite high up there too :o

  • Oh !!!!!!...just looked at the forms....addresses for business in what stae blah blah vlah (State? Are we in America?).

I dont have anyone to go with me except my baby. How pathetic is that? When we were loaded we had friends as far as the eye could see.....

I got loans and cards out in my name because my ex told me we had money coming into the business that we didnt. Im really worried now - could they arrest me if they thought I behaved fraudulently?

    I feel really nauseous. :o
  • Try not to worry  you are taking a step in the right direction now, forget the past and look forward to a brighter future :p

Im over 130k in secured debt (soon also going br) and at the end of the day,you could be in debt for £1000-£100,000 it doesnt matter,if you cant afford it the feelings we all feel are the same eg worry, panic etc

Keep ya chin up and you will get there in the end :p
