Motor Accident - Some Advice If Anyone Can??

Hi there a few days ago i was involved in a car accident (where my car was completely wrote off)
I was parked (and will admit) i was half on Double Yellow Lines. On the road i was parked on there are Cars parked on the left and none on the right. Thing is this is a Major Road where i live and there is enough room to get a Parked Car and Both ways of traffic quite happily flowing up and down the road.
My Accident was that a Drunk Car Driver (4 Times over the legal limit). Some how managed to hit me Full On into the back of my Parked Car (bare in mind that there is enough room to pass the parked cars on the road.
My question is that, who is in the wrong first off. I know he is in the wrong already for being over the limit, but where do i stand legally. I basically now have no car and with him being over the limit and me being half on Double Yellows where do i stand with Insurance. (He was insured)

Feel free to take a look, you can see how wide the road is. Not only that you can also see that the Front end of my car is also totally Crumpled, due to the fact that the Drunk Driver forced my car forward into the car in front. My car however took the major impact and the car in front suffered very little damage (Thankfully)
So my actual question is.... Who is in the wrong? Where do i stand? Can i claim?
Hopefully some one maybe able to point me in the right direction
Many Thanks
Colin

I am sure you can claim, even if you were parked illegally. Its up to the other driver to avoid other cars.
You should be able to claim for your car, and a hire car whilst yours is repaired. Do you have the other drivers insurance details?
The person you were shunted into can also claim, there are same cases were multiple shunt accidents are spread across the various drivers, as you should leave enough space to avoid accidents. However these are few and far between, and involve accidents were the drivers were all in the cars, such as a motorway shunt.0 -
There was a thread on here a few days ago from a guy who had hit a car parked on yellows. He wanted to know if the other guy was to blame. He got short shrift. It's entirely the other driver's fault. It can't be anything else if you drive into a stationary vehicle.

You thought you heard a strange noise coming from the engine and thought it best to stop for a moment to investigate....
Or you just stopped with your back wheel son double yellows... either way he hit a stationary car, it's his fault.0 -
Exactly. Claim away, my friend.0
