well got another kick in the nutts today from Nastywest, after last weeks CCJ hearing in which i was ordered to pay £279 a month on a 28k debt, NW have rejected the court order and are now going after a charging order on my home.
not only that they are also intending to continue charging me 8% interest at a rate of over £200 a month untill the debt is payed off, i have been already paying them over £200 a month as part of my cccs dmp and so far given them £5000 in nearly 3 yrs, all of which has only payed the interest infact its not quite covered that and the debts gone up over a grand.
i had offered the court £233 a month and this was rejected and raised to £279 i will be trying to get this reduced, but NW arnt going to except the £279 anyway.
there will now be a hearing that i will be able to attend, i can only hope i get a fair judge that can see im making every effort and have raised my payments on every revue so far, if i dont get the interest stoped or reduced i will never get the debt payed off without selling my family home..
has anyone else been to a charging order hearing for a large debt, please let me know what to expect

Bloody hell, that is terrible, i am not having the best time at the mo but it seems things for you are going really badly. Not reallly sure what to say to be honest as i am sure it has all been said before. Dont let them beat you though. you would have thought the fact you are trying to pay them back would be enough.0

Unbelieveable!!! For a bank whose slogan is 'Another Way' they have serious customer care issues!!!!Makes me sick every time I see their advert, and say they are looking to help customers make money...err.. shouldn't that be looking to make money out of customers! If I were you I would look for any possible way to appeal aginst this! I am currently in the middle of getting advice from the FO regarding them charging interest on a 5k overdraft and not bothering to tell us they were charging it OR at what rate!!!! As you know they issued a CCJ against us for this, and accepted payment of £83.38 a month, effectively also shooting themselves in the foot. Unfortunately, we were told by CCCS that lenders are becoming more ruthless in their ways to obtain repayment...however...CONSUMERS HAVE RIGHTS - BANKS HAVE RESPONSIBILITIES FOR CUSTOMER CARE!!!!

yes i spoke to the cccs today and they said theres nothing that can be done, it all comes down to the judge at the next hearing, i hope he see's that granting them that amount of interest is pointless as it makes the debt impossible to pay off, i think a charge is now inevitable as it seems to be the done thing now days..0

Firstly a charging order:A charge on a property means that if the property is sold, the charge has usually to be paid first before any of the proceeds of the sale can be given to the judgment debtor. You should note, however, that a charging order does not compel the judgment debtor to sell the property.

So, if Natwest do obtain a charging order then it isn't the end of the world.
In terms of interest, this seems to be a common point recently with NatWest and they seem to be coming down hard on people in DMP's. I'm no expert but I think that now they have a CCJ they can only charge statutory interest (I'm happy to be corrected if thats not the case). I would keep working to get any interest stopped on the basis that you are making every attempt to pay the debt.
I believe you can appeal the judges decision, in terms of the monthly payment, although you will need more knowledgeable advice than mine to see if thats the case - have you tried the CAB?0 -
Good luck, Hope the Judge sees you are making every effort to pay it off, and Natwest are just bullying you. I have just stopped paying Natwest in my DMP, they wouldn't budge on the 19% interest they were charging on the £5500 I owe them. I can see my going down the same road as yourself.0

Nat West don't seem to have any structure to their interest rate and it seems to me they pretty much charge what they feel like. I am sure there must be regulations against this to protect the consumer? When I contacted their credit management centre, even they were unsure as to how the interest had been calculated!!!!Debt at Sept 2006 £63,500:eek:

not sure on the interest scale, but my loan was at 8% apr and thats what it still is. i had an advantage premium account with them (when times were good) which isnt the same as a standed account and i would get benafits such as a personal manager etc and things like a 28k unsercured loan at the drop of a hat.
im just anoyed at myself more than anythng for getting in the mess im in now, i fully inteneded to sell up in 3-5 yrs when i had payed some more off my the debts and morgage and gained more equity to allow us to have a decent deposit on another house. to do it now will mean next to nothing left for a deposit and with having a ccj as of last week cant see that being an option, my wifes now not working as we have just had a baby girl on new years day so she is only on basic maternity pay
i can now only hope a judge see's that im taking the debt seriously and have always made the payments etc and that he will set the interest at a level were the debt will begin to come down, i think we will then have to maybe think about moving in a few years to a cheaper house further out in the sticks and pay it all off as im getting to the point now were this is getting me down..0 -
We had an Advantage Premier account too, they were very quick to flog that one to us when things were good! Our Personal Manager was excellent at bad customer service, and in the end was quite rude!!! Have just spojen with FO and lodged a complaint against them for 2 issues, the first one that they did not bother to tell us the rate of interest they were continuing to apply to the overdraft following the DMP payments and second that we believe they have not been fair in helping us to repay our debt. This applies to you! They have certainly not shown any reasonable behaviour towards your offer of payment and therefore if I were you I would also complain about their lack of responsibility in helping you as a customer! I know you are going back to court, however I think it would still be a worthwhile exercise. Not sure if we will achieve anything, but at least it tells NW we are not going away...Debt at Sept 2006 £63,500:eek:
