how will break affect house and debts

I have a friend, who is without access to the web.

She is currently beginning the process of splitting with her partner.

When they met 6 years ago, she owned a house. He persuaded her to move, and she put his name on the deeds and mortggage, when she had a child, as a gesture of faith and commitment.

He has since run up £30,000.00 debts which have been added to the mortgage.

He is unable to pay the mortgage on his own, and nor is she.

He has offered to sign the house over to her, so she can sell up and find something smaller, with a smaller mortgage.

Will he have any right to any settlement, as he is planning to contribute nothing?

What are her options regarding 'signing over' the house? Can it really be as simple as it sounds?

If anybody has any thoughts or advice, they would be extremely gratefully received.

I ave a dodgy H, so sometimes I will sound dead common, on occasion dead stupid and rarely, pig ignorant. Sometimes I may be these things, but I will always blame it on my dodgy H.

Sorry, I'm a bit of a grumble weed today, no offence intended ... well it might be, but I'll be sorry.

    Please tell her to see a solicitor, and soon.

    Many solicitors offer a 30-minute free consultation, or at least a fixed-fee appointment.

    Nothing is simple in this situation. Assuming that your friend's child will continue to live with her then her husband will be liable to pay maintenance.

    In addition, she might be able to claim back some of the 30,000 that she effectively lent to her husband (by increasing the mortgage).

    Selling the house and buying something smaller might not be the best solution.
