Ok, this isnt straightforward, but Im preempting a possible problem here...
We have a Wii, its 12 months old now and OH decided it was time for a change of case. Went into the modding shop where we bought it and purchased a new Chameleon case for it.
OH takes the Wii apart and puts on the new case. The Chameleon is designed to pulsate with LED's when its used so OH was a little annoyed after spending an hour with it that it didn't work. He checked all possible problems and soon came to the conclusion it was a faulty case.
OH decided to take the whole machine back to the shop so he could demonstrate that the case wasn't working. The guy in the shop, who we usually get on great with, told him to leave the lot and he would take a look. This was monday.
Called the shop yesterday and got the assistant, who told us that yes, the Wii was ready and it had a sticker on it saying £20.
This is where I'm seeing a problem. The case was faulty, the shop owner never said there would be a charge to replace the faulty case or we would have removed the case from the Wii ourselves and got a replacement. So what happens when we go in later and he wants to charge us for it?
I dont have a good feeling about this at all. When we bought the wii from them we were told it contained a more expensive Wiikey modchip, but when it was opened up for the new case to go on we discovered it had an incredibly cheap chip in there and no wiikey. Obviously there is little I can do about this for obvious reasons, but it doesnt fill me with confidence in the place....which is a shame as we always had a good rapport with the guy.
Any advice?

That is complicated. On the surface the case didn't work as sold and so there should be no charge for repairing it. As for the modchip, you're in sticky territory there as I believe they're technically illegal anyway under the UK's implementation of the EUCD legislation so I doubt you'd have any legal clout arguing over consumer right of something that shouldn't be legally sold. I'm not sure about the wiikey or if Nintendo have specifically said they allow chipping but as a general rule they're not allowed to be sold, advertised, owned or used. Hence the forum rules on it.
But the first step would be the same in any case. If you have a good rapport with the guy just politely and calmy explain why you're unhappy and specifically tell him what you had expected (i.e. no charge etc) and see what he says. In ordinary circumstances you'd then escalate matters after that but in yours with the whole modchipping I don't think there's anywhere to escalate it to."She is quite the oddball. In relation to the modchip, I know I'm on a loser with that one, I mentioned it more to illustrate the fact that the guy apparently lied to me when I bought the machine, which only makes me doubt his trustworthiness now.
I think we'll play it by ear and see what happens when we go to collect. As the modchip was fitted over 12 months ago it shouldn't cloud the case issue should it? Its gone in specifically with a faulty case and this is what the £20 charge apparently relates to.0 -

Well I guess you just completely focus on the case which is quite straightforward. It didn't work when bought. Repair/replacement shouldn't cost a thing. I suppose it's possible to escalate that on it's own even to small claims so long as you purely concentrate on the single issue of just the case."She is quite the oddball. go to the shop, make sure you see the wii working and get it in your hands. if there's any talk of 20 charge just say no and walk out. Tell the guy to send you an invoice if he reallys feels that strongy about it.0
