missing parts from a catalogue item

Options
hi hope this is the right board, dont normally do this but need some advice

i purchased a toy garage for my son back in october from the littlewoods catalogue.i purchaed it with a lot of other things which i gave as presents for xmas..but the garage i decided to keep for my sons 1st birthday (tomorrow 17th jan 08)..so the garage has been sitting sealed in the box on my wardrobe for couple of months..i always make any presents that need assembling night before the big day, so just now i started to piece it together, and the whole of the ramps are missing, 3 major parts, so the garage is useless..if you see from the picture below-it is the whole winding ramp-ALL the red ramps.

i have emailed littlewoods as only open till 8pm, i have asked if i can send the item back for a replacement cos i really wanted this garage, or if not could they source me the missing parts..the garage is made by fisher price.
not sure where i stand regarding my rights on this cos its obviously faulty,i'll see what littlewoods say if they reply back, but if anyone could give me some advice , it would be greatly appreciated....really dissapointing cos my son wont be getting the garage he expected.

    Hi there,
In your case as the box was unopened you have a good argument. The item is not fit for purpose and was not as described - it is to a degree irrelevant that you have not told them till now.
They should offer you a refund if they no longer have stock - you are entitled to a refund to your account / card / cash. You are NOT obliged to accept vouchers as the item is faulty.
If they do not replace or refund please let us know and we will advise further!!

    All the best,

    Eph x

Its not as easy as that the item is not faulty , you have had it 3 months so enough time to inspect the item, they could be funny about it if they wanted, how do they know you have just broken the parts ? , Hope fully they will sort it out.

Personally i would ring Fisher Price and they should be able to send the parts out if its a current item and they have stock

They are right (the post above) its not a faulty item.

Littlewoods do not have to do anything about this and they wont be able to proove you didnt open the item.

When ever you buy anything-long distance- you need to inspect it straightaway(or within a resonable timescale)

they will not just be able to send you part of the item out.

I agree with deanos, the best thing to do would be to contact mattel direct and ask them to send the items

Legally, Littlewoods dont need to do anything. You have had the item longer than 28 days, and its not faulty.

By the way, i thought littlewoods were open until 22:30 not 20:00?
  • i had an email from littlewoods last night..they are sending a courier to collect the garage tomorrow.Thay agree the garage is faulty as it is classed as 'missing or incomplete'.
    So all sorted thanks:j
