CIFAS Entry Capital One

Hi All

In October, 2007, I was approved a Capital One credit card. In November I received a letter from Capital One saying that my account was going to be placed in default in 24 days time.

They say the reason for the default was because I made a false or misleading statement in a material respect on my application. You cannot correct this breach.

I sent off for my credit file from Experian and they had placed a CIFAS entry, category 3, Application Fraud facility approved, against my name.:mad:

I have had a further Experian report and this now shows the default. I paid £154, the amount outstanding, in full so the account balance is now clear.

The information which I provided as part of the application was all true. They say that information from the credit reference agencies does not correspond to what I said to them. I have copies of all my 3 credit files and there is nothing to say I had been lying on any of them.

I have contacted Capital One on numerous occasions, however, their Customer relations skills don't appear to be positive.

Is there anybody out there how could offer any assistance in relation to this please?

    under the data protection act you can make a "subject data access request" to capital one - it might cost you about £10 but it means they legally have to provide you with every bit of information they hold on you, which I would expect to include the details of the suspected fraud.

    Yep, you need to find out exactly what they think you have done wrong. Its worth fighting for if your in the clear as a CIFAS will play as much havoc with your rating as going bankrupt or having a CCJ.

    If you read the info and find nothing and dont get much feedback from Cap1 then you probably need to get onto the financial ombudsman (did I spell that right) and make a complaint.

    If you dont think for a second your in the wrong then go at it both guns blazing. Id go mental if some company put a CIFAS on my file as I spent ages making it lovely, shiney and all fantastic!
  • Yes check what they have put on, but the warnign could be from anything lfor eaxmple you could have put on the application that you had 2 other credit cards when infact you have 5, and when they have checked they hace seen you have fice, so that would be classed as fraud. Not saying you have done that, just an example. Thats why im always honest in applications :)

    Thank you for youe advice. I have yet to hear back from Capital One. There is no way I am going to let this drop. I will keep you all informed of any updates.

  • I received my information under the data protection act, however, the information I was looking for was not contained within.

    I have contacted Capital One endlessly. All they say is that the 'ERC Department' is dealing with it. (Complaints Department).

    They have now issed a final response in relation to this problem. It is time to go to the financial ombudsman and let him deal with it.

    It seems they are only too willing to take peoples money and less than willing to deal with customer service!!!

    Anybody else had trouble with Capital One?
