oh my goodness, what a letter....so back to square one - if there are 30 going, then they need to advise and have a 90 day consultation - doesn't sound like they are doing that, or indeed have any plans for *proper* consultation, and no I don't just mean you sitting at home coming up with a plan to save your job ;)

Speak to ACAS and see where you stand, it may be that you can get more money out of them as an additional leaving present, for not bothering to follow the simple process of being made redundant...

I'm really glad you are sounding so positive about it. The world is your oyster now and you get to choose what to do next!!! With a little helping hand, which is more then those that are left will get..... :)

Good luck with ACAS!! and all your new plans tomorrow!!

    Hi Murtle,

I think the 3 month rule is on redundancies of more than 90 people in one establishment but will see what ACAS say :)

blimey I really do keep getting confused with my 30 people - 30 days and 90 people - 90 days - or similar, written like that it looks really easy.....should really concentrate harder!!!

I spoke briefly to ACAS today... they said that as my company was not serving a 30 days consultation period with staff (as there are 20 or more positions at risk) then they were break the law in effect.

The requirement is for a 30 day consultation (obviously full pay) then the notice is serverd at which point your termination notice comes into effect...so for me 1 month...this is then paid in lieu and is tax free.

By not doing this my company is saving 30 staff x 3 weeks salary.

I want to clarify this with someone that else that also know employment law... the problem for me though is I don't want to go back and would rather work elsewhere sooner rather than later... but if I am entitled to two months pay then I want it.... no doubt others made redundant yesterday will need it more.

    I'll keep you posted.
