Just before christmas i was adviced on here to send a "Statute Barred" Letter which i did and i sent it recorded so it needed signing for .......
I sent this after recieving a letter telling me that they were sending a collecter to my house! .. anyway ive heard nothing since !
Until now!!! ....... letter just came through
You have been written to on numerous occasions however the above debt remains outstanding. To avoid further action a monthly repayment plan must be in place within the next 7 days
Therefore as a gesture of goodwill, our client will accept the account to be paid by monthly installments providing the standing order mandate is completed (they enclosed one) ... completed signed and returened to mack hall within 7 days
On reciept of mandate being returned mack hall will not take further action against you providing you do not default payments !
I dont know what to do next ?? am quite worried now! .. will there never get the hint? what should i do ?
many thanks xx

Do nothing they are bluffing . Have you checked on post office site that letter was delivered? Do not phone them, have you CCA requested them ? I would not worry , they will say they will do this and that . Go onto the CAG SITE it has very good legal advice . And one post goes through the court process ,IF it went that far .Which it will not i,m sure . STAY FIRM0

Hold your nerve. Either they have not stopped the auto generated letter deliberately to un-nerve you, or, to give them the benefit of the doubt, they have yet to act upon your letter. Check that they have received your letter. If they have sit tight. Should they continue to send letters to you contact Trading Standards and OFT[strike]Debt @ LBM 04/07 £14,804[/strike]01/08 [strike]£10,472[/strike]now debt free:j

It is most unlikely that MH will send a 'doorstep collector', although I understand that they 'purchased' a company called 'Meritforce Doorstep Collection' last year.
If, and I emphasise if, these thugs do turn up on your doorstep, you need to remember that they would have just about as much authority as your paperboy.
They have NO RIGHT OF ENTRY TO YOUR PROPERTY.
You are under NO OBLIGATION TO DISCUSS THE 'ALLEGED DEBT' WITH THEM.
They MUST LEAVE IMMEDIATELY WHEN YOU ASK THEM TO.
Furthermore, you have disputed the debt - it is against OFT Debt Collection Guidelines for a DCA to pursue a debt which is in dispute.
The 'debt' is statute barred - you have informed MH that you will not be making any payments because the debt is statute barred (the ONLY reason you needed to give). It is contrary to the OFT Debt Collection Guidelines for a DCA to pursue a 'debt' once the debtor has informed them that he will not be paying the debt because it is statute barred.
The onus was clearly on MH to provide proof if they dispute your claim that the debt was statute barred.

I suggest that, in the first instance, you call Trading Standards, explain the situation and ask how to make a complaint against MH.I am NOT, nor do I profess to be, a Qualified Debt Adviser. Ignore the letter, if someone visits ring the police and tell them you are being threatened.
If the ring hang up on them, get call barring if you must.
DO NOT PAY THEM A PENNY!!!!Find out who you are and do that on purpose (thanks to Owain Wyn Jones quoting Dolly Parton)0

have you got a spyhole in your door? if you don't recognise whos at the door don't open it, genuine gas/electric meter reader people etc will have id that they can hold up to the hole for you to see. If not just ask who is there before you open the door. Not that they can come in without your permission anyway but this avoids any confrontation at all.0

This is making me really panicy now! .. Im not a pushy upfront person and tend to back down rather then face conflict! ... If they do send somone out can i just say im still in talks with the company and therefore cannot discuss anything with door knockers?
Im going to check PO site now see if it was delivered
 the letter was delivered 03/12/07
so do i just ignore?Hoping to be a thinner me in 2010!0

I'd also make a complaint to the Financial Ombudsman Service as they should not be chasing a debt that is statute barred after being informed that payment will not be made.
Probably also complain to the Office of Fair Trading so that they can harrass these fools too.If a creditor continues to contact you after accepting that a debt is Statute Barred and you have stated that you no longer intend to pay the debt, you may be able to claim harassment contrary to section 40 (1) of the Administration of Justice Act 1970.After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91
 Dad Gift 6k ¦ Savings & Inv Tst: £2,500
 Loan 10k: £0 ¦ Dad 5.5k: £2,270 ¦ LTSB: £0 ¦ RBS: £0 ¦ Virgin £0 ¦ Egg £0
 Total Owed: £2,270 (+6k) 11/08/20110

IF they do send someone to your door - just tell them you are not willing to discuss it with them and you would like them to leave - if they don't inform them (once) that this is harassment and you will call the police to have them removed.
They have as much right as i do to enter your home - NONE
Try not to worry about it - if the debt is statute barred, the law is on your side and you are under no obligation to pay or even talk with them. After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

Just print off a copy of your original letter. If they turn up, do not let them in and do not say anything. Simply give them a copy of the letter - scribble on it the date that it was recieved by MH, and the name, if legible, of the person? who signed for it. Then ask them to leave - do NOT answer any of their questions - close the door on them.
If they persist - some have been known to shout threats throughletterboxes - ring the police.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
