What happened is that he remortgaged his house and got £25k which was paid to me. There is another £3k outstanding which he has not made any effort to pay. Now, I know for a fact that there IS equity in the property, but the CSA say they won't bother with a charging order as he hasn't!! He bought the house for £100k in about 2001 and others in the street have sold for £200k, so even with the additional £25k loan, there is still lots of equity in the house - I don't believe for one single nano second that his is the only house in the street which is worth only £130k!!!

They made an agreement for him to pay a fiver per week which he failed to do, so they have applied for a Liability Order which is due to be heard mid-Feb. When that is granted, I guess that they will have to go through the charade of appoint bailiffs first which will take weeks on end to return nothing, and then apply for a Committal hearing again!!!

It is my first post so bear with me if ive put the question in wrong place.

I am parent with care with 3 children. My 2 oldest children from my first marriage,17 and 16,no maintenance from their dad, plus he emigrated last year to Australia.
My youngest son is 2years old and his dad and I separated before he was born.We have no contact with him at his request.A D.O.E. set in place for my youngest bolton is my office.
The NRP employed in nhs with a salary of £75,000 plus.the doe in place from aug 06.however for last year I have only received 5 payments out of 12.
I have contacted bolton, complaints resolution officer, ice,mp,and now parliamentary ombudsman, but I am really anxious at moment regarding money.I wonder if there is any point in writing to accounts of csa as NRP,S employees assure me they have made all doe payments and given me the dats too. However I cannot get anyone at all to act or chase up the missing payments and it is now 3 months since any payment at all.The csa pay it erratically.I wont bore anyone with the reasons why csa say they havnt paid.
nrp still employed,no changes to his or my circumstances either.I work full time,a mixture of shift work and I do get some childcare help from tax credits.I was renting after my last separation waited till doe well established before acquiring a mortgage last year,in feb.however now the maintenance seems to have disappeared I am finding things financially a struggle and I am not sure what to do for the best.I really dont want to go thru this year fighting csa again and I really dont want to give up work either. My house is no palace, dont get me wrong, but me and the children love it and It has been a good thing for us all, with the uncertainty of raising a child alone again at 40 years ,renting and on maternity pay was possibly the scariest time of my life.I felt I,d let all my children down so badly.I dont want to be unrealistic about getting maintenance sorted and I really wont bury my head in the sand financially, thanks to this site,I am alot better in confronting problems rather than hoping they will go away.I have read alot of problems with Bolton which does scare me as I dont know how much proactive I can be.I have read alot of advice from Kellogs 36,which always seems sound. Is there anybody that can help me,has anybody an accounts department address,or is writing to them no help.My mp seems to me,mind I am getting paranoid, pretty bored with the saga and I then get very churned up about contacting people.any help at all would be appreciated,Im not very computer literate so apologise if I hav put this in wrong area, thread, etc.:T
I did that for me,as Im exhausted now and have no idea what Im doing, and have never spent so long one finger typing.:j;)however that is for everyone on this site as I think its fantastic.

Does he owe any arrears and have you thought of REMO? See sticky link at the top.

Appears the CSA have lost your money and it's all in their coffers. Contact your MP's assistant and ask them to phone Parliamentary hotline to see if this can be rectified. If this is the case, you want to ask for an ex-gratia payment plus interest. This can be actioned very quickly. ( The same thing has happened to many PWCs, including myself ).
I have contacted bolton, complaints resolution officer, ice,mp,and now parliamentary ombudsman,
You are doing all you can. How far on are you with PO? Have they agreed to take your case on? If so you should be provided with the staff member's name and direct phone number.but I am really anxious at moment regarding money.I wonder if there is any point in writing to accounts of csa as NRP,S employees assure me they have made all doe payments and given me the dats too.
This is what is leading me to believe the CSA has lost it-otherwise the NRP's employees are lying. Sounds highly unlikely as they have provided you with the dates. However, I wonder how you have got these details as it could be classed as classified. However I cannot get anyone at all to act or chase up the missing payments and it is now 3 months since any payment at all.The csa pay it erratically.I wont bore anyone with the reasons why csa say they havnt paid.

Whatever happens keep paying the mortgage.I really dont want to go thru this year fighting csa again and I really dont want to give up work either. You must keep fighting and don't think about giving up work. I've been in the same situation as you and got through it. So can you ;)My house is no palace, dont get me wrong, but me and the children love it and It has been a good thing for us all, with the uncertainty of raising a child alone again at 40 years ,renting and on maternity pay was possibly the scariest time of my life.I felt I,d let all my children down so badly.I dont want to be unrealistic about getting maintenance sorted and I really wont bury my head in the sand financially, thanks to this site,I am alot better in confronting problems rather than hoping they will go away.I have read alot of problems with Bolton which does scare me as I dont know how much proactive I can be.I have read alot of advice from Kellogs 36,which always seems sound. Is there anybody that can help me,has anybody an accounts department address,or is writing to them no help.My mp seems to me,mind I am getting paranoid, pretty bored with the saga MP is there to help his/her constituents, so keep on at them. and I then get very churned up about contacting people.any help at all would be appreciated,Im not very computer literate so apologise if I hav put this in wrong area, thread, etc.:T

Did the NHS bod also explain why they haven't made all the payments they should have? This needs to be referred to the Compliance Inspector to contact the employer to try and 'persuade' them to pay - if not they should prepare the case to go to Court. If you ask this straight question: Has my case been referred to the Compliance Inspector? If not, why not? Will you do that now? If they agree - get the person's name (for future complaints!) and confirm your converstation in writing by recorded delivery and chase up receipt of this letter.

So the employers ARE deducting the payments, and the NRP has therefore paid, but the payments are not getting to you? Is this a clerical case? If so, then I would be jumping up and down and screaming very loudly!!! Have they given ANY explanation as to why this money is not being paid out?

yes all doe,s have been paid to csa bolton.I do have all dates, employees managers name who also has contacted them to no avail.I literally cannot emphasise enough CSA bolton will not listen, pay or do anything. They hve given all sorts of reasons, employees paying into wrong ref no,employees havnt paid it,that its at debt managing part of csa, they say anything actually and yes I do have some of the reasons in letters from them.Thing is I rang again on Friday and they said it all again, and im just not sure how much more I can take of them.It is the most distressing, humiliating horrible texperience I,ve ever been through.my child care bill due again tomorrow and its £780 and yet in reality even though I dont get maintenance for my oldest children, the doe for my youngest does really financially make ahuge difference in our lives.and yes I have jumped up and down and in reality it just makes me feel ill.
