hi my brother lives with my mum and he is her carer, could some one help me my mums want to make a will saying that my brother is to own her house and that she wants him to pay me out of his saving a cash lump sum of around £10,000 so i will have some think when she passes away as well, she has only her house to leave. What would happen if my brother needs to apply for income support will they not give him any help as he gave some of his savings to me viva mums will? Also would the will be a valid will? can mum state that my brother is to give me the cash lump sum in her will? what would happen if he didn't pay me? thanks Diane

AFAIK there would be no problem with your mum leaving the house to your brother. However, I'm pretty sure she can't say what he has to give you out of his savings, as that is his money and not hers. Maybe she could put it as a condition to him inheriting the house, I don't know.
I'm not sure what would be the effect on income support of his inheriting the house as it is his home already.
You may be better advised to discuss this with someone at the CAB who could advise you more fully, or a lawyer.(AKA HRH_MUngo)

She should bequeath specific items or cash to you in the will.
Testators (will makers) should always name trustworthy executors in the will. These are the people responsible for carrying out your mum's wishes.I'll get you, my pretty, and your little dog too!0
