missleading

hi,

i hope u can help me, i have just got a house for rent & was told that it would be in living condition on the day i sign the contact(its a joined tenancy with me & my brother) but i did go on the 7th of January 2008 & signed i when to the house & found that it was in no shap for me nor my nro to live in
when i complained the agensy asked me to give them a list of what i need fixed or done i said that i am not happy & i want my money back this if ofcourse after i paid them by credit card upfront.
they said that i would lose the money & i am in breach of the contract...this is where i cant see how i am so as i did my side of the story & think that they did not deliver the house in a living condtion.....my brother has not signed the contract & is also upset.
i am totaly lost & dont know what to do i cant move in & i cant stay where i am

please help me find the solution.
