Maintenance charges

Just looking for a bit of advice.

We purchased a flat in July 2007 and were advised of our quarterly maintenance charges. Our first invoice came as expected as was paid etc.

However, in December, we received a pack from the management company with copies of receipts for last year's maintenance work together with a long letter explaining how they had overspent on the budget and how payments would need to go up for 2008.

Fair enough. However, they also expected an additional £80 payment for December's payment within 2 weeks.

I find this unfair. They must have known they were near to / had overspent before December and could have warned people.

Can management companies do this and is there anything I could say to them?

  • It depends what the lease says. If, as you have suggested, the payments for a year are split into four equal payments which are payable in Dec (of previous year), Mar, June and September then that is when it should be paid.

    You only know for sure how much you have overspent after you create the accounts which they probably did just before they sent out the December invoice, service charges are variable.

    Why are you asking this question now in January ? Have you received another letter ?

    on one of my flats, each year i get an estimate of management charges at the beginning of the year, and at the end of the year i get another statement saying if i am in credit, or it i owe them money. You can never accurately estimate charges ahead of time.
