Further update:
Seller emailed to say the item at the sorting office wasn't my item
He offered a full refund but then emailed to say that he doesn't have sufficient funds in his paypal account to refund and that he has to transfer funds from his bank account to his paypal account before paypal will let him refund. Does anyone know if this is the case? 0 -
I would have done what Soolin said and put in a claim. I would put one in NOW and tell them everything you have said on here.Thanks for any help and advice given

yes that is correct. it will apparently take 7-9 working days to transfer the funds too.0 -
Refunding from a Paypal account will mean that the seller can claim there Paypal fees back, this is not really your issue, if you are unhappy to wait that long tell the Seller and raisea dispute. Unfortunately it will probably take that long to go through anyway, but it saves any further delays that might arise.0

Even if the refund is forced due to a chargeback it will still take 7-9 days to refund the buyer if there are no funds in the paypal account. The bit about seller getting fees back is a red herring, a proper refund will be the return of the original payment so obviously the paypal fees are returned to the seller as the payment will have bene deemed not to have happened.

I didn't put a paypal dispute in earlier as I was hoping the item at the sorting office was mine - sadly it wasn't and I now know that the seller has insufficient funds in their paypal account to refund so I don't see the value in putting a claim in now.
The seller has 100% positive feedback and has continued to receive positive feedback throughout this, as I have 45 days from payment to put in a claim I plan to leave it a week or so to give the seller a chance to refund once the funds have cleared into his paypal account. Will update with the outcome on here, am very grateful for all the advice/thoughts so far

Sounds like your being a really good and fair buyer... i hope the seller doesn't take advantage.
Glad to see you've noticed the 45 day limit on the claim - just put that into your diary and if it gets within 3-4 days of that, put a claim in regardless to protect yourself - informing the seller politely of course.

Well there's good news and bad news...
The good news is that my parcel arrived this morning 15 days after posting - the bad news is that I bought another identical item 10 hours before it arrived
The item is pretty sale-able so hopefully I'll be able to sell it back on ebay without too much trouble!0
