Over booked hotel

HAYS TRAVEL
I have been trying to get a problem resolved since June 2007.Hays Travel cancelled accomadation less than 12 hours before departure. I asked to cancel but they said go to this other hotel and we would get you fixed out.As I have walking difficulties the hotel we had booked was on the flat but the only hotel available was up 2 steep slopes.
A.B.T.A.says Hays Travel is a member but their job was to act as agent only by passing your booking on to a company with whom you have the contract Therefore your contract is not with the agent but with the principal.Unfortunately they are not A.B.T.A.
So you think if you pay a travel agent they will be responsable.
Citizens Adivce Bureau,Consumer Direct, next will be Small Claims Court.
Anyone else help??
