Hello to all, I need to try and understand what my rights are if any concerning this issue!

I purchased 3 items from the above company prior to Christmas online. About 3 days after ordering I discovered one of the items 5 pounds cheaper in a local store so I tried to cancel it off of my order, HA HA. I phoned numerous occasions, was told I could not cancel the item over the phone and would have to send an email. I did, to the contact address on their website. I also filled in the contact form on the website and sent that through as well. All I received from them was an automated message from the server saying they had received my email.

Anyway just prior to Christmas I received an invoice from them 53.96. I will at this point admit that it was not at the top of my priority list due to the service I had received and I put it to one side, meaning to pay it first thing in January.

Anyway today I received another statement in the post, they have added a 20 pound penalty fee on for non due date payment and a 1.98 surcharge.

This amounts to a 41% charge. I would like to know what rights I have with this, is this legal?

I would appreciate any advice anyone has to offer on this issue.

    I guess the attempt to cancel an order three days after you placed it was not successful and you received the goods.

    If you intended to pay first thing in January, it looks as though that would have been too late in any case if you have already received notice that you were late.

    I also guess they would say their charge is for their costs (time) and that is not directly proportional to the value of the order.

    Seems to me you didn't meet the terms of your contract with them and should pay.

    However, I expect you will get support from others who will say you should challenge the charge.

  • Hi i payed my studio account back in august two days late due to daughter being ill and i couldnt get to bank to pay it. They charged me 20 pounds i emailed them and told them this was not legal.(i didnt know if this was true i was bluffing it). They emailed me back saying they would take charge off. So if i was you i would email them to take charge off.

    did you return the item you tried to cancel ? if not then you must accept a penalty for a late payment whateer te reason you recieved the goosd and failed to pay on time as per your agreement

    Hi Chrissy, I fully accept that I have received the goods, but I will not accept a 41% penalty charge for them no matter what! Does anyone acept the banks horrendous charges any more - NO, so why should any of us have to put up with charges like this from other suppliers?

    I had a very similar experience with studio. They did not respond to my email when i complained that they had only sent 2 of the 3 items that i'd ordered.
    I called them about the horrendous penalty charge. After some discussion, i was offerered a 30 pound voucher. I refused and inisited on speaking to manager. she called me back later in the day and agreed to waive the 30 odd quid penalty.
    My advice would be to call them (get cheaper number on saynoto0870.com) and stand your ground.

    Please don't panic. Have a look at this thread (if it works) or search the forums on Studio 24. You will see loads of people including me have had similar problems with this company and subsequently would not do business with them again. Have heart that most of us have had the admin 'fee' credited, keep cool and email or phone them. It is a very unfair charge and I doubt it would stand up in court.
