Understanding a PCN I received
I have just received a PCN notice from Smart Parking for Tuner Contemporary Car Park, Margate. It is showing photo evidence of my car entering the car park at 14:33 and exiting the car park at 19:46 . I paid using the Ring Go app as instructed on the car park signs but I had problem with the phone signal in the area so it took a while to pay. Here are the payments I made :
- I paid on the RingGo app at 2:42 PM for period time up until 6:42 P.M.
- I then paid on the Ring App to extend the parking , from 6:47 P.M. to 7:47 P.M.
On both occasions I was having problems with the phone signal so it took a while to make payment. From the IPC code of practice it shows that there is a 5 minute consideration period , so I exceeded this , however I note this from a BBC News report : 'Under the change, if motorists pay before they leave ANPR-managed pay on entry car parks, regardless of whether they pay within five minutes, they should not receive a penalty notice.' Also from the IPC code of practice it shows there is a 10 minute grace period which should cover the time it took for me to extend the parking.
I am wondering if anyone could assist in understanding this PCN, whether I should appeal and the chances of appeal being successful ?
Thanks

The BBC should have used the word Parking, not
PenaltyGgenerally speaking, any appeal to Smart Parking or the IAS will be rejected
But wait for more replies due to those details above

Doesn't matter if it succeeds at IAS or not as it will never have to be paid. I would give it a go but never pay anyway.
No rush. @cooldude255220 is very good at drafting IAS appeals.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The reason you got the pcn is you paid for 5 hours parking, but there is a time of 5 hours 13 mins between entering/leaving. That is outside the grace period of 10 mins.
Still, follow the advice above and youll be fine.

Which means they have ignored the CMA's open letter about consideration periods.
