Mortimer Clarke Solicitor SoA

Hi all.

I originally started a thread regarding my current SoA which has now been resolved here:
Self-managed payment plan - SoA check needed first please — MoneySavingExpert Forum

I offered my creditors a payment plan to which MCS sent their own version of my SoA.

I have redacted the upper portion of the SoA which shows account details and signature strip which states the information provided is a true reflection of my financials.
I understand I will input all the same figures as previously but my main question really is the "additional information" box at the bottom.
Does this box have to be filled out? I have explained my position to then numerous times.
Is this just a standard SoA like any other?

Why do they want a SOA? unless it's for a court order you don't have to tell them anything and if you do it doesn't have to be true.

If it is a proper court order application form it will tell you it has to be returned within 30 days.

    Hi. Thanks for the input.

The letter they sent to me is in response to an offer I made to make regular payments based on what I can afford to pay.

Attached to their letter confirming receipt of my offer, they request I fill out their SoA within 14 days to present to their client (Cabot) for approval.

Nothing to do with court air anything like that.

Although I am not lying about my circumstances, I'm not keen on signing anything either as that signature could be used elsewhere on other documents I have not approved or signed for.

    I'm probably overthinking this though

You should stop corresponding to these people. If you are happy with the amount you are proposing to pay them then just set up a standing order, nothing else they can't insist you give them your details.

Frankly, it's none of their business what your other outgoings are. As above, your offer is your offer - it's not a negotiation.

Apologies, I posted on your other thread before realising you'd started this new one

You do not need to provide them with an SOA. I appreciate you have always tried to keep lines of communication with your creditors open, and wanted to continue to take this approach, but you are not helping yourself. As noted on your other thread, pay what you can afford and build your emergency fund.

So, in a basic way, send a letter offering to pay a set amount each month and ask for the bank accounts details for which the funds shall be sent?

What do I do if they insist I fill out and sign their SoA? They will likely try some tactics to continue to threaten a CCJ or something if I don't dance to their tune.

They can't insist you fill out a SOA, they can word things to make you think they can but it's all part off their tactics to try and fool you.

If you can't find bank account details on their website just ask them for them, don't tell or ask them about the amount you will be paying them. We keep telling you not to keep contacting them you must remember the less you do and say the better it is for you.

Morning. Thank you. I really appreciate the assistance and will force myself to remain as minimalistic with them as possible. :)
