Should I appeal to IAS? Armtrac NTK
Hi,
I can’t find a case the same as mine - hope it’s ok to ask!
I received the NTK on 24 Sep and appealed through ARMTRAC’s online form.
“I am appealing solely as the registered keeper of the vehicle and I am not identifying the driver. The alleged parking event occurred on 1 September 2026. The Notice to Keeper is dated 16 September 2026 and was received on 24 September 2026.
The notice therefore does not establish keeper liability under Schedule 4 of the Protection of Freedoms Act 2012. In addition, it does not contain the mandatory warning required by paragraph 9(2)(f).
I am not obliged to identify the driver and will not be doing so. Please cancel the charge or, if you reject this appeal, provide the information required for an appeal to the IAS.”
They rejected it - is IAS the next step please?

It can be, but usually we would say dont bother ! As explained in the newbies sticky thread in announcements near the top of the forum
However, you could look at other recent IAS appeals regarding no keeper liability due to POFA2012 failures and try it, if you want to

Worth a try since it's a black and white paperwork case.
Make it brief and don't waste too much time on it though. The odds are much higher on them withdrawing then the IAS finding for you. So worth it on that basis.4 -
@Gr1pr Thank you, how do I find past cases please? I did read that there wasn’t much point with IAS but couldn’t find a clear cut case like mine to check what others did!

They are not claiming compliance with POFA, so the most likely outcome of an appeal to the IAS is they will give you a load of rubbish about establishing keeper as driver liability on 'balance of probabilities'.

Read the IAS Decisions group thread by coupon mad is one option
I think cooldude has written some recent IAS appeals based on no keeper liability too
The IAS will probably cite Elliott vs Loake and state that the pcn was correctly issued
Dont get your hopes up, its an unregulated biased system so most people will tell you not to bother with an IAS appeal, which is the current advice on here

@cooldude255220 has written several.
Search the forum for sensible keywords. Not Armtrac.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
