John pye deceptive add
hi
I bought an auction for a pair of airpods, https://www.johnpyeauctions.co.uk/Event/LotDetails/587227791
I only looked at the first pic, which is 2gen AirPods, but the rest are 1st gen AirPods, so I think the ad is misleading
I wanted a gen2 AirPods so I’m not happy purchasing those. What do you reckon I should do?
ir is right I should have checked it first but the pics were misleading
what would happen if I decide not to pay it? I heard my account will be blocked but also heard I might be charged the defaulters fee, which is 135+vat
thanks

Have to take your word about the gen 1/2 photos because the differences must be tiny and I can't see them.
The first photo is obviously an Apple marketing shot (unless AirPods really do float in mid-air), the others have been taken for the auction.
Unless there are even more weird rules about buying at auction that I'm aware of then I think you have every right to not buy the item - the item in the photo is not the item you have bid on.
Is there some disclaimer about images not being actual depictions of the item for sale? If not then you are in the right here.

check the black sensor size. Those are clearly different in pic 1 and the others. Pic 1 is marketibg for 2gen but the item is 1gen
question is, if they don’t accept it, what would happen?

Did you register your payment card before you bid?

nop. In worried about the defaulters fee, which is £135 mainly
I don’t care if they block my account and that’s it, just wanted to know if they will chase that money0 -
That's very subtle.
I can't even tell the difference after you pointed it out and looking hard.

yep, exactly my point… I only noticed after looking at some other details in the pic after having placed the bid
so, what are my options now?0 -
yep, no answer yet. I understand they didn’t mention the version/gen, but that does not justify in my opinion the fact they are mixing different products pictures

Bit late to withdraw it, they've already flogged it.

from their terms and conditions:
Any images of the Lot (whether on the Website, in the Important Notes, in brochures, in catalogues or otherwise) are for illustrative purposes only and the Lot may vary from thoseimages. We may use a stock image, not an image of the actual Lot; there will usually beimages showing the Lot itself as well as a stock image. The Lot may comprise of second-hand
items, raw returns, repossessed goods and seized goods. The Lot is sold as seen with no grading or guarantee given, and is sold subject to any faults, defects and imperfections which may subsist at the time of the sale.
It’s an auction. In auctions it’s on the buyer to satisfy themselves as to what they are buying. The description also doesn’t say what generation they are This is something you should have checked beforehand. All shall be well, and all shall be well, and all manner of things shall be well.
Pedant alert - it's could have not could of.1 -
ok, so you are telling me they can sell a device and use stock images of a different one? Isn’t it a fraud?
I have decided not to pay for the invoice so, what’s next? Anybody been in that situation?
