Hi,
Sorry if this isn’t in the correct section.

I/we are looking to make a will, and looking for a bit of advice on how to make one and the cost.
I am guessing it will be a simple Will, we want everything to go to the living partner, then onto to out 3 children.
We are Mortgage free and have saving in different bank accounts in each others name, we have shares as well in my name, and I have 2 pensions which I haven’t touched yet.

I just want a Will that is secure….

Could someone please help me out and explain what I would need to do (in lamens terms).

House is currently worth about £100000.
Me and my wife are aged 56 and 57
All 3 children are from the same family (Me and Wife)

I would repost your question in this forum.

Maybe a good idea to mention you and your partners ages.

I have asked the mods to move it so no need to duplicate the post.

You say partner, does this mean you are not married or in a civil partnership? I ask because not being married or in a CP complicates things and can have significant tax (IHT and CGT) implications on the first death.

You should visit your local solicitors who will be able to produce you and your partner suitable wills that reflect your individual wishes. If you're not married or civil partners, then if you die without a will the rules of intestacy would be followed - gov.uk has a helpful step through guide that sets out what happens in various scenarios.

...everything to go to the living partner, then onto to out 3 children...

First of all, you can't do this if you mean everything to go to the survivor and then when they die be passed to the children. If you bequeath everything to your partner it then belongs to them and you can't have any say in what they do with it. Quite probably they will anyway leave everything to the children but it's not a given.

If you want to write a simple will that essentially says " I leave everything I own to my partner or if they predecease me then equally divided between our children" then November is free wills month and each charity has a list of solicitors who will do this for you for nothing

I think something more than that may be required here, but more info required from the OP. Apart from marital status we need to now if these are all children from this relationship or is this a blended family.

And don't forget putting LPOA's in place as well - you can do these yourself if you feel confident and wish to save some money.

Re the cost: as well as free wills month, if you are working and you or your partner is a member of a trade union you might be able to get simple wills for both drawn up by a solicitor through the union. That's how we did it - mirror wills leaving everything to the survivor and then to the children. Didn't cost us anything, though we did have to sit through the sales pitch for other services (LPOA, trusts, etc). Solicitor will charge you for storing the wills.
