Compensation/UC
I am currently going through a personal injury compensation claim. I don't claim UC at the moment. I do claim PIP and Contribution based ESA.
Can someone advise that if I do start claiming UC what will this be offset against when my claim settles through the CRU recovery unit?
Thanks

Are the benefits you claim and any UC claim all down to personal injury you suffered

Yes pip and ESA contribution I claim due to personal injury I suffered.

Any payment from the DWP should be taken in full from any compensation you are awarded to stop you being paid twice for same injuries. That should be factored in with the PI payment.

Is it not the other way around? If someone has received benefits due to an injury any compensation paid should include the amount of benefits received so as this can be repaid to the DWP.

I reading it we are both stating the same thing.

Ah, yes now I re-read it see that we are.
I interpreted (incorrectly) that you were saying the compensation should be reduced by the amount of benefits claimed.

So my understanding is that if I start receiving UC this will be fully taken into account for recoverable benefits.
ESA will be off set against -loss of earnings
Pip will be off set against -loss of care
Which element will UC be offset against from the compensation? It can't be general damages
