Consumer rights - post warranty design flaw- Ninja airfryer/ multicooker
I bought a Ninja Multicooker- Foodiemax 15 n 1 in 2023 from Argos. The first unit was replaced under warranty after 5 months as the fan failed. Ninja were quick to deal with this. We use this mainly for the air fryer/ pressure cooker/ slow cooker/ steam air fry settings.
Last month a " plug in error" appeared and the unit will not start up.
I don't know if others have had this issue - it seems common from 18 month onwards.
The ninja website advised that this concerned the temperature probe which has never been used. I followed the instruction re cleaning the probe, however this did not resolve the issue and I notified Ninja via the website " was this helpful " - no , and contacted via email, and again this week via the Ai assistant on their website and a follow up email ( I missed the initial response which basically said as warranty expired they could do nothing) I have been offered a 30% reduction on a new unit after this follow up email after discovering that this is a design flaw and bringing it to their attention.
The inherent design flaw in this unit is the wiring for the probe as this passes through the lid hinge. Use over time wears through the protective sheath to the wiring, damages the wires , the power to the probe is cut and the unit will not start up. There are a number of online videos showing the problem and how to fix it - you take off the lid, access the hinge area and solder the broken wires. I'm not a dab hand at soldering, and tbh should not have to do this for a dodgy design issue. Tellingly, new versions of this unit do not have the probe function.
As it is outwith warranty and is a design flaw, how do I best pursue this with Ninja - my next intended step is to phone them.

Your consumer rights are with Argos not Ninja. After 3 years you best outcome is going to be a repair or partial refund.

Even if the original that was bought from Argos was replaced by Ninja under warranty?

If the issue is a design fault then does the warranty period still apply ?

Trouble is, you have statutory consumer rights and completely separate and unrelated warranty provisions.
Once the warranty period has expired then this is no longer relevant, but your statutory consumer rights (which, as above, are with the retailer not the manufacturer, and do offer protection in the event of such inherent faults) are compromised here by the fact that the unit you now have isn't the one the retailer sold you…

The unit was replaced by Ninja via Argos.

In which case go back to Argos, not Ninja.
