DCB Legal - letter of claim
Hello everyone,
I've received a Letter of Claim and, after reading through several posts on here, decided to start a new thread to ask for some advice.
Do you think it's worth defending this claim, or would I be better off settling it?
The situation is as follows: I was in London for work and parked my car late at night. None of the payment machines were working, and I also tried to pay through the app, but it wouldn't accept the payment. I took several videos showing the issues, along with screenshots from the app.
I later received a PCN, which I appealed, providing the screenshots and explaining what had happened. The appeal was rejected, so I took it to POPLA. That appeal was also unsuccessful, with POPLA stating that other motorists had managed to pay, despite the fact that the app wasn't working for me.
At that point, feeling that the charge was completely unfair given the circumstances and the evidence I'd provided, I decided to ignore further correspondence.
Now that I've received a Letter of Claim, I'm wondering whether I have reasonable grounds to defend it.
One additional detail: the car is registered in my wife's name, but I was the one driving it at the time. The Letter of Claim has been issued in her name.
We initially submitted the appeal in her name because we expected the charge to be cancelled. However, we later tried to transfer the appeal and deal with the matter in my name as the actual driver, but we were unsuccessful.
Would this make any difference to how we should approach the defence? Should my wife respond to the Letter of Claim as the registered keeper, or would it be better to identify myself as the driver at this stage?
Any advice would be greatly appreciated. Thanks in advance for your help!

100% defend the claim if/when it comes.
It is optional whether she responds to the LBC
All set out in the Newbies thread

Why would you settle, when every - YES, EVERY - defended DCB Legal ParkingEye claim is discontinued before the hearing, and nobody pays a penny?
Did you miss @Umkomaas' thread?!
😀
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It's not a case. It's a thousand examples to show that defended DCB Legal claims for certain firms (ParkingEye is one) are ALWAYS discontinued before the hearing, and nobody pays a penny
