Civil Enforcement Ltd - Exceeded time
Hi all
I ran out of time when I parked in a bay as was in a rush and misread the sign. I should have put £2.50 in and only put £2.00. I assumed from the sign it would be £1 an hour, but only had 2 options: up to 1 hour (£1) and up to 4 hours (£2.50), However I was only parked for an hour and 45 minutes so the parking company didn't lose any money as I paid £2 for the 2 hours I was there.
As I exceeded the time, I got a fine from Civil Enforcement. I tried to appeal it but they refused, so have now sent me a claim for £260, which I am obviously contesting.
I have put in my AOS through MCOL, and am about to write my defence. Should I just adapt the part I need to so say what I said above? ie The parking company didn't lose out on any money, or is there something specific that I should put in like when dealing with companies like Smart Parking?

The alleged breach is pleaded, so
Add and driver to the end of paragraph 2 ( if true )
For paragraph 3, deny the alleged breach and state that full payment was made for the time that the vehicle was parked and that the defendant was a valid customer of the business ( if true. ) study other recent cases for exact wording of your bespoke paragraph 3
Use all 10 paragraphs, by adding the rest of the template defence in announcements
