GroupNexus / CP Plus – late NTK, no windscreen ticket – keeper appeal advice?
Hi all,
I’d appreciate some advice before appealing a GroupNexus / CP Plus parking charge from Broughton Shopping Park.
Timeline:
- Parking event: 29 Aug 2026
- No windscreen ticket
- First postal notice dated: 16 Sep 2026
- First notice received: 24 Sep 2026
- Second letter dated: 1 Oct 2026
- Second letter received: around 5 Oct 2026, now demanding £100 in full within 14 days
I am the registered keeper and private owner of the vehicle. I have not contacted GroupNexus yet and have not identified the driver.
My understanding from reading the NEWBIES thread is that, because there was no windscreen Notice to Driver, the Notice to Keeper needed to be delivered within 14 days under Schedule 4 of POFA 2012 if they want to hold the keeper liable.
If that is correct, the deadline would have been 12 September, but their first notice was not even dated until 16 September and did not arrive until 24 September.
So am I right in thinking they may have lost the right to pursue me as keeper, even if they could still potentially pursue the driver if they knew who that was?
My proposed appeal is:
I am appealing as the registered keeper.
No Notice to Driver was served.
The alleged parking event was on 29 August 2026, but the Notice to Keeper was dated 16 September 2026 and was not received until 24 September 2026.
As the notice was not delivered within the 14-day period required by Schedule 4 of the Protection of Freedoms Act 2012, you cannot transfer liability to me as keeper.
I will not be identifying the driver.
Please cancel the charge or provide a POPLA verification code.
For context, the charge relates to parking in a disabled bay without displaying a Blue Badge. There was no Blue Badge holder in the vehicle. I had two young children with me and the parent-and-child spaces were full. I also observed Blue Badge holders using the remaining parent-and-child spaces instead of the available disabled bays.
I appreciate that this probably does not provide a defence in itself, so I’m unsure whether it is worth mentioning in the appeal or whether I should keep everything focused on the POFA / keeper-liability point.
A few questions:
- Is the POFA / 14-day argument correct here?
- Should I use the short appeal above or the standard NEWBIES template?
- Are there any recent GroupNexus / CP Plus cases with the same late-NTK issue?
- Is there anything else on their notice that I should check for to strengthen the appeal?
- Should I leave the disabled-bay circumstances out and focus only on keeper liability?
- Does the second £100 letter change anything, or should I just appeal now?
Thanks for any guidance, especially links to similar successful cases or POPLA appeals.

Dont mention the situation, stick to the Pofa2012 arguments, which are correct on timescales, the NTK PCN letter must be posted no later than 2 business days before the 14 day deadline, in order to arrive in time ( presumed delivered. )
Use the appeal above, not the generic blue text template
Probably hundreds of similar lae NTK cases here on MSE
POFA2012 is more han timescales, check the content against the examples by coupon mad linked in the newbies sticky thread in announcements
Correct, focus on no keeper liability
That is an irrelevant reminder letter
But
I suspect that the deadline for a keeper appeal has passed ( 28 days after the issue date or delivered date )
As for popla, study the Popla Decisions thread

Thanks for your reply.
I have drafted out the below as my appeal wording. Would you mind sense checking to see if it sounds suitable to send today? Many thanks
I appeal as the registered keeper. No Notice to Driver was affixed to the vehicle or otherwise served at the time of the alleged parking event on 29 August 2026.
Accordingly, paragraph 9 of Schedule 4 of the Protection of Freedoms Act 2012 applies.
The Notice to Keeper is dated 16 September 2026 and was not received until 24 September 2026. Paragraphs 9(4) and 9(5) require a Notice to Keeper to be delivered within the relevant 14-day period. The statutory period had already expired before your notice was even issued.
Furthermore, the Notice to Keeper does not appear to contain the mandatory wording required by paragraph 9(2)(e), including the statement that the creditor does not know both the name of the driver and a current address for service for the driver.
Nor does it contain the mandatory warning required by paragraph 9(2)(f), namely that, subject to compliance with Schedule 4, the creditor would have the right to recover the unpaid parking charge from the keeper after the applicable 28-day period. A statement concerning possible debt recovery action is not the warning required by paragraph 9(2)(f).
Accordingly, the requirements necessary to transfer liability from the driver to the registered keeper have not been met. There is no keeper liability under Schedule 4.
I will not be identifying the driver.
Please cancel the charge. If you reject the appeal, please provide a POPLA verification code.

As long as the content is correct, then it looks ok

Sorry but that grinds my gears.
You don't have any right to a special bay. Disabled motorists have a legal right. You don't.
I was a busy mum with 4 kids under 8 years old and when they were small, I rarely used a (retail gimmick: they are totally meaningless) parent & child bay but certainly not a blue badge bay. My goodness that is selfish entitlement. Sorry but there is no way you should have done that, and you certainly don't parrot it to a parking firm, thinking it's OK.
I mean - don't pay the charge, of course not - but DO change your mindset when out & about by car. Never ever take a disabled bay just because you have kids.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
