parking charge notice

I had a PCN in April which I appealed and lost. I still haven't paid and am now getting letters/emails from debt collectors. I'm planning on ignoring these as I'm quite happy to go to court and argue my case. You often read/hear 'just ignore it all and it'll go away' but does anybody have any experience of this stage or advice of what to expect.

Some detail.

This is a Mcdonalds car park in Gloucester.

I was 14 minutes over a 90 minute parking limit. 10 of those 14 minutes were a grace period meaning in my eyes, I was 4 minutes over. (I do question how I spent so long in a Mcdonalds but have absolutley no evidence to contridict the time stated, I do have proof that I was in McDonalds).

I appealed on the grounds of not receiving the notice to keeper within 14 days, the first I knew about it was a last chance to pay letter. POPLA replied with this;

'Regarding the Notice to Keeper, we have provided a copy of the letter and a certificate of postage in section B. Under Paragraph 9(6) of Schedule 4 of the Protection of Freedoms Act 2012, the notice is deemed to have been delivered on the second working day after the day on which it was posted unless the contrary can be proven. As the appellant has not proven their claim that it was not received, the Notice to Keeper is deemed to have been delivered on 29/04/2026'

I stated that proof of postage does not prove proof of delivery and asked how I prove I haven't actually received something.

Finally, I see it as a £100 charge for 4 minutes of parking, £25 a minute which surely at best is quite extortionate.

Any views would be very welcome.

    Name the private parking company claimant involved

    Your latter argument died 11 years ago with the Supreme Court in the Barry Beavis court case

    As for how it all works, study the over 953 cases in the discontinuations thread by Umkomaas

    Meanwhile, ignore the powerless debt collectors letters

    "Finally, I see it as a £100 charge for 4 minutes of parking, £25 a minute which surely at best is quite extortionate."

    Which is legally incorrect, as advised above, so forget that.

    But all MET Parking/DCB Legal threads are discontinued in the end when defended. See post 2 of the NEWBIES thread.

    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
