Negleted to file defence - BW Legal
In need of guidance, please.
I received claim from BW Legal on behalf of Napier parking dated 19 Aug. As i intend to defend it, filed AOS on 5 September and somehow negleted to file the defence, which was due 21 September. Received a letter for BW Legal today, dated 23 September, advising they have not yet applied for a CCJ and offering a monthly installement payments, giving me until 14 October to respond to them. Looked on MCOL, and no info /or CCJ is noted. Am i too late or should I email the defence to the CNBC straight away?I am also planning on phoning the CNBC to see if BW Legal has filed for a default judgment has or anything is in the pipeline, awaiting processing. Would you recommend this approach or should i cut my losses and settle?

I would login to mcol ASAP, and file the defence ASAP if they haven't used the request judgment button, beating them to it
Definitely not email, MCOL only. !

Come on this is easy. Template defence, get it in NOW. It isn't too late. You are lucky BW Legal remind people.
Once it is done you can relax and follow the 8 steps.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you. Submitted the defence last night using the template from here, which i find exceptionally helpful. It also appreas they may have skipped the pre-court steps as I only ever received a NTK about the alleged failure to pay/display which was in December 2025, then nothing until the Claim form from CNBC on 19 August 2026, followed by a letter from BW legal dated 20 August that CCC has been issued. Going to prepare myself asking for a SAR now to fill the gaps, as i am obviously getting only some of their correspondence.

Unlike DCB, BW Legal don't like default CCJs I've noticed. They want the money, not a piece of paper.2
