DCBL - Court Claim
Hi all,
I have received a DCBL court claim for an alleged offence from almost 3 years ago. The issue date was on the 11th September and I have already done the acknowledgment of service, which I believe takes me up until the 14th October to file a defence.
I have read the defence template and the information on the pinned posts and have kept the defence template as it is (para 1 and 4-10), however just need some advise for paras 2 and 3 below.
2. The allegation(s) are vague and liability is denied for the sum claimed, or at all. The delay in bringing proceedings lies with the Claimant, making retrieving material evidence difficult, which is highly prejudicial. The Defendant has little knowledge of events, save as set out below, however admits that they were the registered keeper and driver.
3. The Particulars of Claim state only that the vehicle “Remained on Private Property in Breach Of The Displayed T&Cs”. They fail to identify the conduct which is alleged to constitute the breach. The Defendant draws the Court’s attention to the persuasive appeal judgment in Civil Enforcement Limited v Chan (Ref. E7GM9W44), in which HHJ Murch held that the particulars did not set out the conduct amounting to the alleged breach. Similarly, in Car Park Management Service Ltd v Akande (Ref. K0DP5J30), HHJ Evans held that Particulars of Claim must set out the basic facts upon which a party relies to prove the claim. The same deficiency arises here and the Defendant submits that the claim should be struck out under CPR 3.4.
Any guidance would be appreciated. Thank you!

Definitely Wasn't DCBL , look again, its from DCB LEGAL, on behalf of their client ( who is it. ? )
No offence occurred, just an alleged breach of the parking contract on that private property
Post a redacted picture of the POC from the lower left of the claim form below after hiding the VRM details first

Hey, thank for your reply. Here you go. Apologies, the AI eraser on my phone has changed the wording of some things when trying to redact, but all of the information should be on there.
It was from ParkingEye initially and then DCB Legal stepped in. The issue date is 11 Sept 2026, not 2025.

So as I stated, its DCB LEGAL, no actual breach pleaded, use the Chan and Akande defence template

Here's the exact same thing answered earlier today. Like Groundhog Day on here sometimes!
Please don't ask us to check the 10 para defence. There's nothing to check!
See you in 2027 when you proudly strut back with your Notice of Discontinuance picture!
