LBC - Advice on response to Gladstones

Hi,

Sadly i've had an issue with a historical charge that I did have a paid ticket for:

  • Paid for parking but keyed the wrong reg number
  • Appealed PCN
  • Never saw the response via email - I JUST DISCOVERED IT (DOH!! - was in spam)
  • LBC followed
  • Now getting 2nd round of LBC's 2 years on…

I have just complained to the landowner.

I have 8 days left on Gladstones 30 day dispute deadline and want your advice:

  • Do I use their web portal to create a login and dispute the charge on the basis even for a major keying error the max charge should be £20 based on BPA code of practice?
  • Is it better to email Gladstones direct (assuming I can find an email via the forum)?

Your advice is much appreciated!

Use the portal, log the LoC response on there, but no filling in their forms

    Or

    Use emails

Many thanks, so no preference on the method then by the sounds of it as long as i'm not filling their forms in …

Any advice on the LBC response wording? - Plan to challenge based on having bought a ticket (I have a photo), and BPA limit of £20 max fine…

The response is in the 2nd post in the newbies sticky thread in announcements near the top of the forum

    There Is NO FINE

  • Thanks!

This one? (with added point about having bought a ticket?)

…You should revert to your client because the 'propensity to pay' score in my case is zero, so any claim is hopeless and a waste of the court fee (whether 'fronted' by your firm or not). Move on to weaker victims.

The alleged 'debt' is disputed and any court proceedings will be vigorously defended…

    Which parking firm?

Did you type in a different number-plate by mistake, or a partial one (usually caused by the machine, not you).

BPA AOS or IPC AOS? You can tell by the roundel on the signs and the PCN.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Firm was CPS.

It wasn't the machine, I put our other car's reg in by mistake…

    IPC.

The original response to my appeal in 2024 offered the £20 fee, but as mentioned I didn't see that at all till a few days ago :-(

So its UK CPS , using Gladstones Solicitors

Keying error by the driver, so they offered the £20 option in their response by email 2 years ago

But the car park has ANPR (how else could they have contacted you if they didn't know your VRM and ask DVLA for Registered Keeper's address) so they/the system could have checked if the VRM you keyed in was not in the car park and rejected it!

None of it matters! I assume you mean UKCPS of Leeds?

Just play the game, per post 2 of the NEWBIES thread then use the Template Defence guidance when a Claim Form arrives.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks so to confirm: I will respond via email to Gladsones via enquiries@gladstonessolicitors.co.uk using the template from Post 2 (below) with a line added about having actually paid for a ticket/keying error etc

Then expect a claim, which I will defend as per further advice/templates.

    Anything I missed?

    Dear Sirs,

    Your ref: [insert reference number]

    Proposed legal proceedings

Claimant: [insert name of parking company]

I refer to your letter of claim.

I confirm that my address for service for the time being is as follows, and any older address must be erased from your records:

    [Insert correct address here]

You should revert to your client because the 'propensity to pay' score in my case is zero, so any claim is hopeless and a waste of the court fee (whether 'fronted' by your firm or not). Move on to weaker victims.

The alleged 'debt' is disputed and any court proceedings will be vigorously defended.

    Yours faithfully,
