Euro CarParks - POPLA appeal rejected
Hi All.
Hoping someone can give me some advice.
I received a PCN from Euro Carparks after parking at Rochdale Road, Manchester. The PCN said id overstayed according to their ANPR. i sent them a copy of my ticket showing their ANPR said i left at 16.03, but my ticket was till 16:04. They then pointed out my ticket was missing the first two digits of my reg. Therefore it was a major keying error and i had to pay £20. Or if i appealled they would remove that offer and id be liable for the full amount.
I appealed to POPLA. ECP sent their evidence pack and my reg minus the first two digits is blatantly on their ANPR log. I have also looked into the site and it's noted as a problem site for 'keying errors'.
I then submitted my comments to POPLA, who bizarrely sent me a reply today saying my appeal is rejected.
What should I do next?

Ignore them for now
Ignore any powerless debt collectors letters too
ECP machines are notoriously faulty, so much so that videos of them exist and also they are currently being investigated by the CMA too, so read their recent open letter to all private parking companies
Eventually this will be dealt with at court level when ECP and DCB Legal discontinue the case , same as hundreds of other cases in the thread by Umkomaas

Im happy if this did go to court. Any decent person (judge) would see i left in time, they could tell id paid for a ticket. It's pain wrong and a rip off. Who gets a ticket out of a machine and says I must double check the reg is right on the ticket. Most would, as I did, check the time and put it on the dash

Agreed, but a judge will never see it or rule on it

Hopefully. I'm to stubborn for my own good sometimes. So I will see this through against these cowboys

Next time come here earlier. You should never have tried POPLA.
It is impossible to win these cases at POPLA because all they do is see if a PPC has followed the bent (self-serving) Code of Practice. Which allows their members to bribe people to pay £20 when in fact, evidence shows that the cause and the common denominator is the machine.
You should have told ECP to do one and 'see you in court'. You'll never have a hearing as long as you defend any court claim. They are ALL discontinued; it is a massive numbers game relying on weak people folding and paying.
I'd simply ignore them now and fight back by sending your evidence of the faulty machine ticket to the CMA. They DO NOT help individuals but they are collecting evidence. The common denominator is the faulty machines:
Watch Lynda's video.
Then read this, you'll see the pattern:
Euro Car Parks could be fined because the CMA have already opened a formal consumer protection investigation into them specifically.
Did you miss that news?!
Read it NOW. 😀
Now is the time to alert the CMA to every unfair ECP case here. We should no longer ignore ECP, we should ALL push them into a hole!
This investigation has only just opened - mere weeks ago - and they are calling for evidence about matters including that firm's conduct surrounding appeals.
Send your evidence of the misprinted (machine error) ticket and ECP's appeal rejection to the CMA. Tell them why you and other right-thinking people believe the £20 bribe is outrageous!
CMA Contact emails (use both, the first one goes directly to their parking investigation) :PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
