AOS deadline missed?

IMG_5072 (2).jpeg

Hi, I appear to have missed the AOS deadline which was yesterday at 4pm, i hurriedly filed it, would this mean i will get a deafult ccj? Should i file the defence as as soon as possible? When i was acknowledging it said the website said it might accept the extension if the claimant hasn't filed for a defualt issue, does this mean i still have time? Claim history just shows.

A claim was issued against you on 09/09/2026

Your acknowledgment of service was submitted on 29/09/2026 at 13:54:52.

Many thanks for any help

  • Here is my current drafted defence which i am going to submit now although since its past 4pm they said there wont be any acknowledgement until tommorow

3.The Particulars of Claim allege 'Failure To Pay For Full Duration Of Stay' on 22 January 2026. The Defendant has little recollection of the circumstances of the alleged parking event and cannot now recall who was driving. The Defendant therefore cannot admit the alleged breach and requires the Claimant to prove the contractual terms relied upon, the alleged period of parking, the amount allegedly paid (if any), the amount allegedly due, and the legal basis upon which the Defendant is said to be liable.

Your AOS is in dont rush the defence

Your proposed paragraph 3 is mainly what can be at the end of paragraph 2

Think about it and look at other recent threads

Paragraph 3 should refute the POC

With an issue date of 09/09/26 and providing you complete(d) the AoS before or on 28/09/26 your defence deadline date is 4.00 p.m. on 12/10/26

As long as you get the AOS in before they apply for Summary Judgement (which you did), you are fine. Work towards your defence now, which is due by 12 Oct

@Funyun123 you have plenty of time to defend, now the AOS is in (even late).

Was your PCN like this one, with a 30% discount?

I would mention that as it is a blatant breach of the Code of Practice early payment discount rules, which have set it at 40% or more for a good 15 years!

I would NOT say you can't remember who was driving or anything about it because that's surely not true? It was this year after all.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Thank you here is my rewritten and submitted defence:

    2. The allegation(s) are vague and liability is denied for the sum claimed, or at all. The delay in bringing proceedings lies with the Claimant, making retrieving material evidence difficult, which is highly prejudicial. The Defendant has little knowledge of events, save as set out below and to admit that they were the registered keeper and driver.

    3. The Defendant contends that the signage at the site was sparse and insufficiently prominent to bring the relevant parking terms and conditions to the driver’s attention. Further, the Defendant contends that the early-payment discount arrangements failed to comply with the Code of Practice early payment discount rules.
