Smart parking / DCP Legal court claim

Hi,

I’ve received a court form from DCB Legal on behalf of Smart Parking. I’ve already done the acknowledgement and just preparing my defence.

My particular of claims are as follows:

1 the defendant is endeared to the claimant for a parking charge issued to vehicle XXX at rugby club

2 the date of contravention December 2024

3 the defendant is pursued as the driver of the vehicle for breach of terms on the signs (the contract). Reason: insufficient paid time

4 in the alternative the defendant is pursued as the keeper pursuant to POFA 2012 schedule 4

AND THE CLAIMANT CLAIMS

1 £170 being the total costs of the PC and damages

2 interest at a rate of 8.00% per annum pursuant to s69 of the county courts act 1984 from the date hereof at a daily rate of £0.04 until judgement or sooner payment

3 costs and court fees.

I want to acknowledge being the driver as it’s key to the facts of my defence. Essentially I arrived late, it was busy and not great weather. I parked close to the stands, and quickly went there to watch the remainder of the game. There is no obvious signage on that path. Visitors are meant to register their number plate in the club house which I didn’t realise. Or pay, but I didn’t see the signs. I’ve since gone back and there is signage at the very enterance but I didn’t take that in whilst driving. Most of the signage makes it clear that the car park is being camera recorded but not so clear on payment.

If using the template, is it a case of removing paragraphs 3 and 9 which reference POFA?

Many thanks,

Nope don't remove para 9. It is relevant to refer to the POFA's maximum sum even in cases where the driver is admitted.

Para 3 is your facts, so you can write whatever you want! It'll be discontinued in 6 months or so anyway.. they all are.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Standard DCBL stuff, adding a fake £70 which is a feeble attempt of DOUBLE RECOVERY which the courts do not allow.

This fake was introduced by the two ATA's and is not legal or a law

It is the OSNER SCAM who is a director of the BPA …. JUST EXTORTION
