Got PCN from ParkingEye on Academy Land

I got a PCN from parking eye when the driver unknowingly parked on school land. it was totally dark - no lights or signs that anyone could see. Already gone through appeal, POPLA and LBCCC and I expect they will send a claim in about 4 weeks time.

But I was wondering - this is a Academy and more complex this school was on PFI. So I wondered about the leases. I should have challenged this sooner - but anyway. Since ParkingEye states "this is private land not council land". Though it is still council land!

I have done a FOI for the leases and any permissions to run a commercial parking scheme. As well as sent a email to the estates section for information on permissions for parking, commercialisations, any planning permissions, why ANPR and not just a gate.

Anyone have experience in dealing with scenario.

Thanks in advance.

Was this in Scotland or not?

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

do not identify the driver, never use terms like i did this, he, she or even friend, father, uncle etc

Good sleuthing. But almost all Parking Eye claims are discontinued nowadays, so you probably won't have chance to use it! Unless you confront them with it before a claim.

You could counterclaim when the time comes if you were desperate for a hearing and compensation of some sort.

I only plan to use this information during court if absolutely necessary though I have the feeling that it's all so complex (Council, PFI, Academy, DfE etc..) that it goes beyond small claims.

My plan is to point the council that the Academy is in breach that Academy needs to rectify by cancelling all PCN and tear down the parking management.

In the meantime I prepare for the Claim.

ParkingEye sent their usual - ignore LBCCC documents and queiries and just pay up response.

I was wondering if I should reply with "you are misbehaviing . What can I show debt advisors if you don't send me evidence".

    Anyone done that?
