Section 13 4a - Dates

I am sending out my first Section 13 rent increase to my tenants (with whom I have a great relationship).

The tenancy started on 18th September 2021, however they wanted to pay their rent on 1st of the month, so when they moved in they paid 13 days which took them up to and inc. 30th September 2021 and then they paid thereon on 1st of every month.

Their first increase was on 1st December 2022 and the most recent increase was on 1st December 2025.

On sections 4.3 (most recent rent increase), 4.4 (first rent increase) and 4.6 (rent increase date) do I put 1st of the month or 18th? A4 in the Notes section states “the new rent must start at the beginning of a tenancy period…”. In my case their tenancy period runs 18th to 17th, even though they pay their rent on 1st.

Any advice would be very much appreciated - thank you.

    It's very clear, they pay the increased amount from the tenancy date, so you're going to have to work out how to organise it. Add the percentage extra to the first payment at the new rent? Or just let them off those days?

    Typical new legislation, another example of them not knowing how the real world operates

    4.3 (most recent rent increase) = 1st Dec 2022

    4.4 (first rent increase) = 1st Dec 2025

    4.6 (rent increase date) = 18th Dec 2026

    That way its at the start of a period and at least 1 year after the last one.

    I'd ask for the normal amount on 1st Dec, then on either 18th Dec or 1st Jan, ask for the 14 days extra.

    Would it be easier if I issued them a new APT tenancy agreement (leaving the inventory and deposit alone), dated 1st?
